AN ACT

 

1Amending the act of April 14, 1972 (P.L.233, No.64), entitled
2"An act relating to the manufacture, sale and possession of
3controlled substances, other drugs, devices and cosmetics;
4conferring powers on the courts and the secretary and
5Department of Health, and a newly created Pennsylvania Drug,
6Device and Cosmetic Board; establishing schedules of
7controlled substances; providing penalties; requiring
8registration of persons engaged in the drug trade and for the
9revocation or suspension of certain licenses and
10registrations; and repealing an act," providing for dismissal
11of police officers upon conviction of certain offense and for
12dismissal of firefighters upon conviction of certain offense.

13The General Assembly of the Commonwealth of Pennsylvania
14hereby enacts as follows:

15Section 1. The act of April 14, 1972 (P.L.233, No.64), known
16as The Controlled Substance, Drug, Device and Cosmetic Act, is
17amended by adding sections to read:

18Section 23.1. Police Officer Dismissal.--Notwithstanding any 
19other provision of law to the contrary, a police officer who is 
20convicted of an offense under section 13(a)(12), or a 
21substantially similar offense in another state, shall be 
22summarily dismissed from employment.

23Section 23.2. Firefighter Dismissal.--Notwithstanding any

1other provision of law to the contrary, a firefighter who is
2convicted of an offense under section 13(a)(12), or a
3substantially similar offense in another state, shall be
4summarily dismissed from employment.

5Section 2. This act shall take effect in 60 days.
