AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, defining the offense of assault by
3 AIDS carrier; and providing a penalty.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 18 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 § 2712. Assault by AIDS carrier.
9 Any person who has tested positive for HIV infection in
10 relation to acquired immune deficiency syndrome (AIDS) and, with
11 knowledge of same, willfully assaults another in a manner likely
12 to transfer the infection commits a felony of the first degree.
13 Section 2. This act shall take effect immediately.
