                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for driving under influence of
     3     alcohol or controlled substance.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3731(a) of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 3731.  Driving under influence of alcohol or controlled
     9             substance.
    10     (a)  Offense defined.--A person shall not drive, operate or
    11  be in actual physical control of the movement of a vehicle in
    12  any of the following circumstances:
    13         (1)  While under the influence of alcohol to a degree
    14     which renders the person incapable of safe driving.
    15         (2)  While under the influence of any controlled
    16     substance, as defined in the act of April 14, 1972 (P.L.233,
    17     No.64), known as The Controlled Substance, Drug, Device and

     1     Cosmetic Act, to a degree which renders the person incapable
     2     of safe driving.
     3         (2.1)  While under the influence of the fumes from any
     4     substance containing a solvent having the property of
     5     releasing toxic vapors or fumes to a degree which renders the
     6     person incapable of safe driving.
     7         (3)  While under the combined influence of alcohol [and],
     8     any controlled substance or substance defined in paragraph
     9     (2.1) to a degree which renders the person incapable of safe
    10     driving.
    11         (4)  While the amount of alcohol by weight in the blood
    12     of:
    13             (i)  an adult is 0.10% or greater; or
    14             (ii)  a minor is 0.02% or greater.

    16     Section 2.  This act shall take effect in 60 days.
