                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," further providing for
     4     child care.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  The act of June 13, 1967 (P.L.31, No.21), known
     8  as the Public Welfare Code, is amended by adding sections to
     9  read:
    10     Section 912.  Information to State Police.--The department
    11  shall require all boarding homes for children and all facilities
    12  providing child day care, as defined in section 1001, to submit
    13  the names and dates of birth of all children entering the


     1  institution for the first time to the Pennsylvania State Police,
     2  in accordance with procedures established by the Pennsylvania
     3  State Police, within twenty-one days of receiving the child for
     4  care.
     5     Section 1004.  Information to State Police.--As a condition
     6  of licensure, the department shall require all boarding homes
     7  for children and all facilities providing child day care to
     8  submit the names and dates of birth of all children entering the
     9  institution for the first time to the Pennsylvania State Police,
    10  in accordance with procedures established by the Pennsylvania
    11  State Police, within twenty-one days of receiving the child for
    12  care.
    13     Section 2.  Section 1076 of the act, added December 5, 1980
    14  (P.L.1112, No.193), is amended to read:
    15     Section 1076.  Regulations.--The department is hereby
    16  authorized and empowered to adopt regulations establishing
    17  minimum and reasonable standards for the operation of family day
    18  care homes and the issuance of registration certificates. These
    19  regulations will establish the minimum standards of safety and
    20  care which will be required in family day care homes and will
    21  recognize the vital role which parents and guardians play in
    22  monitoring the care provided in family day care homes. The
    23  regulations shall include a provision which requires a family
    24  day care home to submit the names and dates of birth of all
    25  children entering the home for the first time to the
    26  Pennsylvania State Police, in accordance with procedures
    27  established by the Pennsylvania State Police, within twenty-one
    28  days of receiving the child for care.
    29     Section 3.  This act shall take effect in 60 days.
