AN ACT
1 Authorizing and directing the Department of Transportation, with
2 the approval of the Governor, to convey to the Borough of
3 Freemansburg a tract of land situate in the Borough of
4 Freemansburg, Northampton County.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Borough of Freemansburg, Northampton County.
8 (a) Conveyance authorized.--The Department of
9 Transportation, with the approval of the Governor, is hereby
10 authorized and directed, on behalf of the Commonwealth, to grant
11 and convey for fair market value by quitclaim deed to the
12 Borough of Freemansburg, Northampton County, the parcel of land
13 described in subsection (b).
14 (b) Property description.--A parcel located on the east side
15 of S.R. 3005 (Main Street), between stations 15+82 and 17+98,
16 more or less triangular in shape, and containing 0.297 acres, as
17 shown on a property plat of the Department of Transportation for
18 Legislative Route 3005, section 01B R/W, Northampton County,
1 Parcel Nos. 5 and 6, sheet Nos. 8 and 9, Claim Nos. 4803295-97
2 and 4803296-97.
3 (c) Underground drain pipe easement.--The deed authorized
4 herein shall reserve to the grantor a ten-feet-wide underground
5 drain pipe easement from the east side of the legal right of way
6 line of S.R. 3005, section 01B, to the easterly property line,
7 containing 679.75 square feet, as shown on the property plat
8 described in subsection (b).
9 (d) Conditions of conveyance.--The conveyance shall be made
10 under and subject to all easements, servitudes and rights of
11 others, including, but not confined to, streets, roadways and
12 rights of any telephone, telegraph, water, electric, sewer, gas
13 or pipeline companies, as well as under and subject to any
14 interest, estates or tenancies vested in third persons, whether
15 or not appearing of record, for any portion of the land or
16 improvements erected thereon.
17 (e) Deed.--The deed of conveyance shall contain a clause
18 that the property conveyed shall be used for municipal purposes
19 by the Borough of Freemansburg, and, if at any time the Borough
20 of Freemansburg or its successor in function sells or transfers
21 the property or permits the property to be used for any purpose
22 other than those specified in this section, the title to the
23 property shall immediately revert to and revest in the
24 Commonwealth of Pennsylvania.
25 (f) Execution of deed.--The deed of conveyance shall be
26 approved as provided by law and shall be executed by the
27 Secretary of Transportation in the name of the Commonwealth of
28 Pennsylvania.
29 (g) Costs and fees.--Costs and fees incidental to this
30 conveyance shall be borne by the grantee.

1 Section 2. Effective date.
2 This act shall take effect immediately.
