AN ACT 1 Amending the act of June 19, 1961 (P.L.453, No.225), entitled 2 "An act requiring employers to pay for medical examination 3 fee where such examination is a condition for employment, and 4 providing a penalty," further regulating requirements of 5 medical examinations for employment. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Sections 1 and 2 of the act of June 19, 1961 9 (P.L.453, No.225), entitled "An act requiring employers to pay 10 for medical examination fee where such examination is a 11 condition for employment, and providing a penalty," are amended 12 to read: 13 Section 1. As used in this act-- 14 (1) "Employer" means an individual, partnership, association 15 or corporation, a legal representative, trustee, receiver, 16 trustee in bankruptcy, and any common carrier by rail, motor, 17 water, air or express company, doing business in or operating
1 within the Commonwealth. The term "employer" shall include the 2 Commonwealth of Pennsylvania. 3 (2) "Employe" includes every person who may be permitted, 4 required or directed by any employer, as defined in section 2, 5 in consideration of direct or indirect, gain or profit, to 6 engage in any employment. 7 Section 2. It shall be unlawful for any employer to require 8 any employe or applicant for employment to pay the cost of a 9 medical examination, or the cost of furnishing any medical 10 records, required by the employer as a condition of employment, 11 if the applicant or employe works for the employer for one work 12 week[: Provided, That the provisions of this act shall not apply 13 where medical examination is required by law as a condition of 14 employment]. 15 Section 2.
