| AN ACT |
| |
1 | Amending Title 18 (Crimes and Offenses) of the Pennsylvania |
2 | Consolidated Statutes, providing for the offense of unlawful |
3 | use of computer scrub software and for the offense of |
4 | unlawful use of the Internet; and making an editorial change. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. The heading of Subchapter E of Chapter 76 of |
8 | Title 18 of the Pennsylvania Consolidated Statutes is amended to |
9 | read: |
10 | SUBCHAPTER E |
11 | ELECTRONIC MAIL |
12 | AND INTERNET OFFENSES |
13 | Section 2. Title 18 is amended by adding sections to read: |
14 | § 7662. Unlawful use of Internet. |
15 | (a) Offense defined.--A person commits the crime of unlawful |
16 | use of the Internet if the person is subject to registration |
17 | requirements under 42 Pa.C.S. § 9795.2(a) (relating to |
18 | registration procedures and applicability) and as a condition of |

1 | parole or probation is prohibited from accessing the Internet, |
2 | social networking websites or other actions defined under 42 |
3 | Pa.C.S. § 9795.6 (relating to limited Internet access). |
4 | (b) Grading.--In addition to being subject to penalties |
5 | prescribed under section 4915 (relating to failure to comply |
6 | with registration of sexual offenders requirements) an offense |
7 | under this section shall constitute a felony of the third |
8 | degree. |
9 | (c) Definition.--As used in this section, the term |
10 | "commercial social networking site" means any business, |
11 | organization or other similar entity operating a website that |
12 | permits persons to become registered users for the purpose of |
13 | establishing personal relationships with other users through |
14 | direct or real-time communication with other users or the |
15 | creation of web pages or profiles available to the public or to |
16 | other users. The term does not include an electronic mail |
17 | program or a message board program. |
18 | § 7642. Unlawful use of computer scrub software. |
19 | (a) Offense defined.--A person commits the crime of unlawful |
20 | use of computer scrub software if the person is subject to |
21 | registration requirements under 42 Pa.C.S. § 9795.2(a) (relating |
22 | to registration procedures and applicability) and as a condition |
23 | of parole or probation is prohibited from using computer scrub |
24 | software under 42 Pa.C.S. § 9795.7 (relating to prohibited use |
25 | of computer scrub software). |
26 | (b) Grading.--In addition to being subject to penalties |
27 | prescribed under section 4915 (relating to failure to comply |
28 | with registration of sexual offenders requirements), an offense |
29 | under this section shall constitute a misdemeanor of the third |
30 | degree. |

1 | (c) Definition.--As used in this section, the term "computer |
2 | scrub software" means any third-party added software, designed |
3 | to delete information from the computer unit, the hard drive or |
4 | other software, which would eliminate and prevent discovery of |
5 | browser activity, including Internet history, address bar, cache |
6 | and cookies and which would overwrite files in a way so as to |
7 | make previous computer activity, including website access, more |
8 | difficult to discover. |
9 | Section 3. This act shall take effect in 90 days. |
