AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, providing for use of unmarked police vehicles. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Title 75 of the Pennsylvania Consolidated 6 Statutes is amended by adding a section to read: 7 § 6304.1. Use of unmarked police vehicles. 8 (a) Stopping vehicles.--A police officer may not attempt to 9 stop a moving vehicle for a summary traffic offense while 10 driving a vehicle which is not clearly identifiable by its 11 markings as a police vehicle. 12 (b) Use of unmarked vehicle.--Nothing in subsection (a) 13 shall prohibit the use of unmarked police vehicles in other 14 traffic law enforcement activities excluding actual traffic 15 pursuits and stops. 16 (c) Following vehicles.--Officers in full uniform in 17 unmarked cars who observe a traffic violation may follow the 18 subject vehicle until a marked police vehicle can engage in the
1 actual traffic stop. Officers engaging in following in an 2 unmarked car shall wear their uniform hats and turn on the 3 interior dome lights of their vehicles so that the motorist can 4 see them. 5 (d) Public notice.--The Pennsylvania State Police shall 6 effectively publicize the provisions of this section for at 7 least five years from the effective date of this section. 8 Section 2.
