                                     AN ACT

     1  Amending Title 24 (Education) of the Pennsylvania Consolidated
     2     Statutes, further providing for eligibility for limited early
     3     retirement.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 8313 of Title 24 of the Pennsylvania
     7  Consolidated Statutes is amended by adding paragraphs to read:
     8  § 8313.  Eligibility for limited early retirement.
     9     Notwithstanding any provisions of this title to the contrary,
    10  the following early retirement provisions shall be applicable to
    11  eligible members:
    12         * * *
    13         (3)  Any member who, during the period of time from the
    14     effective date of this paragraph through July 31, 2005:
    15             (i)  has credit for at least 30 eligibility points;
    16             (ii)  terminates school service; and


     1             (iii)  files an application for an annuity with an
     2         effective date not later than July 1, 2005,
     3     shall be entitled to receive a maximum single life annuity
     4     calculated pursuant to section 8342 without any reduction by
     5     virtue of an effective date of retirement which is under the
     6     superannuation age.
     7         (4)  Any member who, during the period of time from April
     8     1, 2006, through July 31, 2006:
     9             (i)  has credit for at least 30 eligibility points;
    10             (ii)  terminates school service; and
    11             (iii)  files an application for an annuity with an
    12         effective date of retirement not later than July 31,
    13         2006,
    14     shall be entitled to receive a maximum single life annuity
    15     calculated pursuant to section 8342 without any reduction by
    16     virtue of an effective date of retirement which is under the
    17     superannuation age.
    18         (5)  Any member who, during the period of time from April
    19     1, 2007, through June 30, 2007:
    20             (i)  has credit for at least 32 eligibility points;
    21             (ii)  terminates school service; and
    22             (iii)  files an application for an annuity with an
    23         effective date of retirement not later than July 1, 2007,
    24     shall be entitled to receive a maximum single life annuity
    25     calculated pursuant to section 8342 without any reduction by
    26     virtue of an effective date of retirement which is under the
    27     superannuation age.
    28         (6)  Any member who, during the period of time from April
    29     1, 2008, through June 30, 2008:
    30             (i)  has credit for at least 31 eligibility points;

     1             (ii)  terminates school service; and
     2             (iii)  files an application for an annuity with an
     3         effective date of retirement not later than July 1, 2008,
     4     shall be entitled to receive a maximum single life annuity
     5     calculated pursuant to section 8342 without any reduction by
     6     virtue of an effective date of retirement which is under the
     7     superannuation age.
     8         (7)  Any member who, during the period of time from April
     9     1, 2009, through June 30, 2009:
    10             (i)  has credit for at least 30 eligibility points;
    11             (ii)  terminates school service; and
    12             (iii)  files an application for an annuity with an
    13         effective date of retirement not later than July 1, 2009,
    14     shall be entitled to receive a maximum single life annuity
    15     calculated pursuant to section 8342 without any reduction by
    16     virtue of an effective date of retirement which is under the
    17     superannuation age.
    18     Section 2.  This act shall take effect immediately.
