AN ACT
Amending Title 66 (Public Utilities) of the Pennsylvania
Consolidated Statutes, in railroads, further providing for
speedometers and speed recorders and for flag protection and
providing for railroad safety inspector salary.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Sections 2705(e) and 2706(d) of Title 66 of the
Pennsylvania Consolidated Statutes are amended to read:
§ 2705. Speedometers and speed recorders.

(e) Enforcement.--The commission shall enforce the
provisions of this section, including expanding the commission's
enforcement actions through increased railroad safety
inspectors, and may issue such order or orders as may be proper
to require compliance therewith.
§ 2706. Flag protection.

(d) Enforcement.--The commission shall [enforce] take

appropriate enforcement actions, including expanding the
commission's complement of railroad safety inspectors, to ensure
compliance with the provisions of this section.
Section 2. Title 66 is amended by adding a section to read:
§ 2710. Railroad safety inspector salary.
(a) Salary.--Notwithstanding any other provision of law to
the contrary, the commission shall set the base salary of
$120,000 for a railroad safety inspector employed at the
commission.
(b) Cost of living.--Beginning July 1, 2024, and for each
like 12-month period thereafter, t he commission shall increase
the base salary of a railroad safety inspector under subsection
(a) by the percentage change in the Consumer Price Index for All
Urban Consumers (CPI-U) for the Pennsylvania, New Jersey,
Delaware and Maryland area for the most recent 12-month period
for which figures have been officially reported by the United
States Department of Labor, Bureau of Labor Statistics
immediately prior to the date the adjustment is due to take
effect. The percentage increase and salary amounts shall be
determined by the commission and shall be transmitted to the
Legislative Reference Bureau for publication in the next
available issue of the Pennsylvania Bulletin within 20 days of
the date the determination is made.
Section 3. The addition of 66 Pa.C.S. § 2710 shall apply to
contracts or agreements entered into on or after the effective
date of this section.
Section 4. All regulations and parts of regulations are
abrogated to the extent of any inconsistency with the provisions
of this act.
Section 5. This act shall take effect in 60 days.
