AN ACT 1 Amending the act of July 7, 1980 (P.L.380, No.97), entitled "An 2 act providing for the planning and regulation of solid waste 3 storage, collection, transportation, processing, treatment, 4 and disposal; requiring municipalities to submit plans for 5 municipal waste management systems in their jurisdictions; 6 authorizing grants to municipalities; providing regulation of 7 the management of municipal, residual and hazardous waste; 8 requiring permits for operating hazardous waste and solid 9 waste storage, processing, treatment, and disposal 10 facilities; and licenses for transportation of hazardous 11 waste; imposing duties on persons and municipalities; 12 granting powers to municipalities; authorizing the 13 Environmental Quality Board and the Department of 14 Environmental Resources to adopt rules, regulations, 15 standards and procedures; granting powers to and imposing 16 duties upon county health departments; providing remedies; 17 prescribing penalties; and establishing a fund," providing 18 for recycling of hydrochloric acid-based waste pickle liquor; 19 and prohibiting certain persons from accepting hydrochloric 20 acid-based waste pickle liquor for processing and disposal. 21 The General Assembly of the Commonwealth of Pennsylvania 22 hereby enacts as follows: 23 Section 1. The act of July 7, 1980 (P.L.380, No.97), known 24 as the Solid Waste Management Act, is amended by adding a 25 section to read:
1 Section 304. Hydrochloric acid-based waste pickle liquor 2 recycling. 3 (a) Within three years of the effective date of this 4 section, a person engaged in a manufacturing process of which 5 hydrochloric acid-based waste pickle liquor is a by-product 6 shall recycle all waste pickle liquor that is derived from 7 hydrochloric acid-based processes. 8 (b) A person may petition the Environmental Quality Board 9 for an exemption from the requirement of subsection (a). The 10 Environmental Quality Board shall review each petition and 11 conduct a hearing in accordance with 2 Pa.C.S. (relating to 12 administrative law and procedure) within 90 days of submission 13 of the petition. 14 (c) On and after three years following the effective date of 15 this section, the operator of a municipal or residual waste 16 processing or disposal facility or of a hazardous waste storage, 17 treatment or disposal facility, whether or not the facility 18 possesses a permit from the department under this act, may not 19 accept hydrochloric acid-based waste pickle liquor generated 20 within or outside this Commonwealth for storage, disposal or 21 processing, except for recycling. 22 (d) As used in this section, the term "recycle" means the 23 recovery and sale, reuse or regeneration of hydrochloric acid- 24 based waste pickle liquor which would otherwise be disposed or 25 processed as waste. 26 Section 2.
