                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for contraband.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Section 5123(a) of Title 18 of the Pennsylvania
     6  Consolidated Statutes, amended December 19, 1988 (P.L.    ,
     7  No.158), is amended to read:
     8  § 5123.  Contraband.
     9     (a)  Contraband to confined persons prohibited.--A person
    10  commits a [misdemeanor] felony of the [first] second degree if
    11  he sells, gives, or furnishes to any convict in a prison, or
    12  inmate in a mental hospital, or gives away in, or brings into
    13  any prison, mental hospital, or any building appurtenant
    14  thereto, or on the land granted to or owned or leased by the

     1  Commonwealth or county for the use and benefit of the prisoners
     2  or inmates, or puts in any place where it may be secured by a
     3  convict of a prison, inmate of a mental hospital, or employee
     4  thereof, any kind of spirituous or fermented liquor, drug,
     5  medicine or poison or any controlled substance included in
     6  Schedules I through V of the act of April 14, 1972 (P.L.233,
     7  No.64), known as The Controlled Substance, Drug, Device and
     8  Cosmetic Act, (except the ordinary hospital supply of the prison
     9  or mental hospital) without a written permit signed by the
    10  physician of such institution, specifying the quantity and
    11  quality of the liquor or substance which may be furnished to any
    12  convict, inmate, or employee in the prison or mental hospital,
    13  the name of the prisoner, inmate, or employee for whom, and the
    14  time when the same may be furnished, which permit shall be
    15  delivered to and kept by the warden or superintendent of the
    16  prison or mental hospital.
