AN ACT
Amending the act of July 8, 1986 (P.L.408, No.89), entitled, as
reenacted, "An act providing for the creation of the Health
Care Cost Containment Council, for its powers and duties, for
health care cost containment through the collection and
dissemination of data, for public accountability of health
care costs and for health care for the indigent; and making
an appropriation," providing for chargemaster data.
The General Assembly of the Commonwealth of Pennsylvania hereby
enacts as follows:
Section 1. Section 3 of the act of July 8, 1986 (P.L.408,
No.89), known as the Health Care Cost Containment Act, reenacted
and amended June 10, 2009 (P.L.10, No.3), is amended by adding a
definition to read:
Section 3. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:

"Chargemaster." A uniform schedule of charges represented by
a hospital or health care facility as its gross billed charge

for a given service or item, regardless of payer type.

Section 2. Section 6(c)(20) and (21) of the act are amended
and the subsection is amended by adding a paragraph to read:
Section 6. Data submission and collection.

(c) Data elements.--For each covered service performed in
Pennsylvania, the council shall be required to collect the
following data elements:

(20) patient discharge status; [and]
(21) provider service effectiveness and provider quality
pursuant to section 5(d)(4) and subsection (d)[.]; and
(22) the chargemaster from each hospital and ambulatory
service facility, which must be submitted annually to the
council by March 31, and must include the following:
(i) Medical test name fully spelled out as in the
American Medical Association Current Procedural
Terminology (CPT) manual.
(ii) Medical test CPT code.
(iii) Medical test charge rounded to the nearest
dollar.

Section 3. Section 7 of the act is amended by adding a
subsection to read:
Section 7. Data dissemination and publication.

(c) Availability of chargemaster data.--The council shall
make available the chargemaster for each hospital and ambulatory
service facility licensed within this Commonwealth. The council

shall make this information available to the public on its
Internet website or through a request pursuant to the provisions
of section 10.
Section 4. This act shall take effect in 60 days.
