                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for criminal history
     3     definitions and regulations.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 9102 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended by adding definitions to read:
     8  § 9102.  Definitions.
     9     The following words and phrases when used in this chapter
    10  shall have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     * * *


     1     "Volunteer emergency worker."  Any of the following:
     2         (1)  An individual who:
     3             (i)  meets the definition of "emergency medical
     4         technician" in section 2 of the act of July 3, 1985
     5         (P.L.164, No.45), known as the Emergency Medical Services
     6         Act; and
     7             (ii)  serves without compensation.
     8         (2)  An individual who:
     9             (i)  drives a vehicle staffed by an individual
    10         referred to in paragraph (1)(i); and
    11             (ii)  serves without compensation.
    12     "Volunteer firefighter."  A member of a nonprofit chartered
    13  corporation, association or organization which is:
    14         (1)  located in this Commonwealth; and
    15         (2)  provides fire protection services in this
    16     Commonwealth.
    17     Section 2.  Section 9121(b)(1) of Title 18 is amended to
    18  read:
    19  § 9121.  General regulations.

    21     (b)  Dissemination to noncriminal justice agencies and
    22  individuals.--Criminal history record information shall be
    23  disseminated by a State or local police department to any
    24  individual or noncriminal justice agency only upon request.
    25  Except as provided in subsection (b.1):
    26         (1)  A fee may be charged by a State or local police
    27     department for each request for criminal history record
    28     information by an individual or noncriminal justice agency,
    29     except that no fee shall be charged to [an] any of the
    30     following:

     1             (i)  An individual who makes the request in order to
     2         apply to become a volunteer with an affiliate of Big
     3         Brothers of America or Big Sisters of America.
     4             (ii)  A volunteer emergency worker.
     5             (iii)  A volunteer firefighter.

     7     Section 3.  This act shall take effect in 60 days.
