AN ACT 1 Providing for a voluntary contribution system to finance a 2 program to assist persons needing organ transplants. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Purpose. 6 It is the purpose of this act to provide a means for the 7 residents of this Commonwealth to make voluntary contributions 8 to assist persons needing organ transplants. 9 Section 2. Contributions. 10 (a) Blank to be provided.--The Department of Revenue shall 11 provide a space on the face of the Pennsylvania individual 12 income tax return form whereby an individual may voluntarily 13 designate a contribution of any amount desired to assist persons 14 needing organ transplants. 15 (b) Deduction from refund.--The amount so designated by an 16 individual on the income tax return form shall be deducted from
1 the tax refund to which the individual is entitled and shall not 2 constitute a charge against the income tax revenues due the 3 Commonwealth. 4 (c) Transfer.--The Department of Revenue shall determine 5 annually the total amount designated pursuant to this act and 6 shall report such amount to the State Treasurer, who shall 7 transfer such amount from the General Fund to the Organ 8 Transplant Fund. 9 (d) Information.--The Department of Revenue shall provide 10 adequate information concerning the Organ Transplant Fund in its 11 instructions which accompany State income tax return forms, 12 which shall include the listing of an address, to which 13 contributions may be sent by those taxpayers wishing to 14 contribute to the fund but who do not receive refunds. 15 Section 3. Organ Transplant Fund. 16 (a) Creation.--In order to carry out the purposes of this 17 act, there is hereby created in the State Treasury a special 18 fund which shall be known as the Organ Transplant Fund. 19 (b) Deposit.--All moneys received from the voluntary 20 contribution system established in section 2 shall be deposited 21 in the special fund. 22 (c) Future appropriations.--The General Assembly may, from 23 time to time, appropriate funds into the special fund for the 24 purposes of this act. 25 (d) Continuing appropriation.--The moneys contained in the 26 Organ Transplant Fund shall not lapse and are continuously 27 appropriated to the Department of Health for the exclusive 28 purpose of carrying out the provisions of this act. 29 Section 4. Program. 30 The Department of Health shall be responsible for developing 19890H0989B1711 - 2 -
1 and administering a program that will utilize the moneys
2 contributed to the Organ Transplant Fund. In carrying out the
3 program, the department shall coordinate the services to the
4 fullest extent possible with existing programs and resources
5 that are available for assisting persons needing organ
6 transplants.
7 Section 5. Repeals.
8 Section 12 of the act of June 23, 1982 (P.L.597, No.170),
9 known as the Wild Resource Conservation Act, is repealed insofar
10 as it is inconsistent with this act.
11 Section 6. Applicability.
12 This act shall apply to taxable years beginning on or after
13 January 1, 1988 1989. <--
14 Section 7. Effective date.
15 This act shall take effect immediately.
