        REFERRED TO COMMITTEE ON TRANSPORTATION, APRIL 5, 1989

                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for expenditures for the emission
     3     inspection program; and providing a penalty.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 4706(a) of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended and the section is amended by
     8  adding subsections to read:
     9  § 4706.  Prohibition on expenditures for emission inspection
    10             program.
    11     (a)  General rule.--Except as provided in [subsection (b)]
    12  subsections (b) and (b.1), neither the department nor any other
    13  department or agency of the executive branch of State government
    14  shall expend any public funds for the establishment and
    15  administration of any system for the periodic inspection of
    16  emissions or emission systems of motor vehicles.

     1     (b.1)  Financial responsibility.--The department shall bear
     2  the financial responsibility for all costs resulting from
     3  requirements of the program ordered by a Federal court.
     4     * * *
     5     (f.1)  Restraint of trade.--Any restraint of trade by a
     6  person or corporation regarding the maintenance, repair or
     7  calibration of emission analyzers is prohibited. A violation of
     8  this subsection constitutes a misdemeanor of the third degree.

    10     Section 2.  This act shall take effect in 60 days.
