                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," prohibiting school officials or
     6     employees from recommending that a child use psychotropic or
     7     sympathomimetic drugs.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    11  as the Public School Code of 1949, is amended by adding a
    12  section to read:
    13     Section 1422.1.  Psychotropic Drugs.--(a)  No school official
    14  or employe shall recommend that a student use any psychotropic
    15  or sympathomimetic drugs.
    16     (b)  Subsection (a) shall not prohibit:
    17     (1)  School medical staff from recommending appropriate
    18  evaluation of a student by a medical practitioner.
    19     (2)  School personnel from consulting with the medical


     1  practitioner with the consent of the student's parents or
     2  guardians.
     3     (c)  Definitions.--As used in this section, the following
     4  words and phrases shall have the meanings given to them in this
     5  subsection:
     6     "Psychotropic."  Exerting an effect upon the mind; capable of
     7  modifying mental activity; usually applied to drugs that affect
     8  the mental state.
     9     "Sympathomimetic."  An agent that produces effects similar to
    10  those of impulses conveyed by adrenergic postganglionic fibers
    11  of the sympathetic nervous system.
    12     Section 2.  This act shall take effect immediately.
