                                     AN ACT

     1  Prohibiting the Commonwealth and business entities from
     2     collecting, storing and distributing digitized signatures and
     3     photographs under certain circumstances.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Use of digitized signatures and photographs.
     7     (a)  State agencies.--
     8         (1)  It shall be unlawful for an officer, employee or
     9     agent of a State agency, department, board or commission,
    10     acting within the scope of that person's official duties,
    11     employment or agency, to collect, possess, maintain, store or
    12     distribute digitized signatures or photographs of persons for
    13     any purpose.
    14         (2)  A State agency, department, board or commission that
    15     has in its care, custody or control digitized signatures or
    16     photographs on the effective date of this act may not


     1     distribute the signatures or photographs.
     2     (b)  Business entities.--
     3         (1)  It shall be unlawful for a business entity to
     4     solicit, collect, store or distribute digitized signatures or
     5     photographs of persons for any purpose without the informed
     6     written consent of the persons.
     7         (2)  A business entity that has in its care, possession,
     8     custody or control digitized signatures or photographs on the
     9     effective date of this act may not distribute the signatures
    10     or photographs without the informed written consent of the
    11     persons.
    12  Section 3.  Enforcement.
    13     The Office of Attorney General shall enforce the provisions
    14  of this act.
    15  Section 4.  Effective date.
    16     This act shall take effect in 60 days.
