                                     AN ACT

     1  Amending Title 51 (Military Affairs) of the Pennsylvania
     2     Consolidated Statutes, further providing for leaves of
     3     absence for certain government employees.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 4102 of Title 51 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 4102.  Leaves of absence for certain government employees.
     9     (a)  Mandatory.--
    10         (1)  All officers and employees of [the Commonwealth, or
    11     its] instrumentalities of the Commonwealth, or any political
    12     subdivision [thereof] of the Commonwealth, or its
    13     instrumentalities, who are members of the Pennsylvania


     1     National Guard, shall be entitled to leave of absence from
     2     their respective duties without loss of pay, time or
     3     efficiency rating on all days during which they shall, as
     4     members of the Pennsylvania National Guard, be engaged in
     5     active State duty. All such officers and employees shall, in
     6     addition, be entitled to leave of absence from their
     7     respective duties without loss of pay, time or efficiency
     8     rating on all days not exceeding 15 days in any one year
     9     during which they shall, as members of the Pennsylvania
    10     National Guard, be engaged in training or other military duty
    11     under orders authorized by Federal or State law. All such
    12     officers and employees shall, in addition, be entitled to
    13     unpaid leave of absence from their respective duties without
    14     loss of seniority or efficiency rating on all days in excess
    15     of 15 days per year during which they shall be engaged in
    16     training or other military duty under orders authorized by
    17     Federal or State law.
    18         (2)  All officers and employees of the Commonwealth or
    19     its instrumentalities who are members of the Pennsylvania
    20     National Guard shall be entitled to leave of absence from
    21     their respective duties without loss of pay, time or
    22     efficiency rating on all days during which they shall, as
    23     members of the Pennsylvania National Guard, be engaged in
    24     active State duty. All such officers and employees shall, in
    25     addition, be entitled to leave of absence from their
    26     respective duties without loss of pay, time or efficiency
    27     rating on all days not exceeding 30 days in any one year
    28     during which they shall, as members of the Pennsylvania
    29     National Guard, be engaged in training or other military duty
    30     under orders authorized by Federal or State law. All such

     1     officers and employees shall, in addition, be entitled to
     2     unpaid leave of absence from their respective duties without
     3     loss of seniority or efficiency rating on all days in excess
     4     of 30 days per year during which they shall be engaged in
     5     training or other military duty under orders authorized by
     6     Federal or State law.
     7     (b)  Discretionary.--The Commonwealth, its instrumentalities
     8  and political subdivisions thereof and their instrumentalities
     9  shall be authorized and permitted to provide paid military leave
    10  or other compensation and/or continue medical and other benefits
    11  to members of the Pennsylvania National Guard and other reserve
    12  components of the United States Armed Forces for days in excess
    13  of [15 per year] those provided in subsection (a) when the
    14  member shall be engaged in training or other military duty under
    15  orders authorized by Federal or State law.
    16     Section 2.  This act shall take effect in 60 days.
