        AS RE-REPORTED FROM COMMITTEE ON APPROPRIATIONS, HOUSE OF
           REPRESENTATIVES, AS AMENDED, FEBRUARY 14, 2000

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing school lunch AND SCHOOL      <--
     6     BREAKFAST reimbursement payments from the Commonwealth and     <--
     7     incentives for offering school breakfast programs.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    11  as the Public School Code of 1949, is amended by adding a
    12  section to read:
    13     Section 1337.1.  School Lunch Reimbursement.--(a)  Subject to  <--
    14  future adjustments under subsection (b), each school which


     1  offers the lunch program shall receive an additional
     2  reimbursement of two cents (2¢) for a total reimbursement of
     3  eight cents (8¢) per lunch served for the 1998-1999 school year.
     4     (b)  For the 1999-2000 school year, and each school year
     5  thereafter, financial incentives shall be fixed by regulation of
     6  the Department of Education. No financial incentives shall be
     7  less than the amounts established in subsection (a) for the
     8  1998-1999 school year.
     9     (c)  Financial incentives shall be paid to participating
    10  schools during the school year in which they are earned based on
    11  reports submitted to the Department of Education.
    12     (d)  For the purposes of this section and section 1337.2,
    13  "school" shall have the same meaning as given to that word in 7
    14  CFR § 210.2 (relating to definitions).
    15     Section 2.  The act is amended by adding a section to read:
    16     Section 1337.2.  School Breakfast Incentive.--(a)  Subject to
    17  future adjustments under subsection 1337.1(b), each school which
    18  offers both a lunch program and a breakfast program shall
    19  receive an additional reimbursement of two cents (2¢), for a
    20  total reimbursement of ten cents (10¢) per lunch served for the
    21  1998-1999 school year.
    22     (b)  Subject to future adjustments under subsection
    23  1337.1(b), any school which serves breakfast to more than twenty
    24  per centum (20%)  of its student enrollment shall receive a
    25  reimbursement of twelve cents (12¢) per lunch served for the
    26  1998-1999 school year.
    27     SECTION 1337.1.  SCHOOL LUNCH AND BREAKFAST REIMBURSEMENT.--   <--
    28  THE COMMONWEALTH SHALL REIMBURSE EACH SCHOOL OFFERING A SCHOOL
    29  LUNCH OR SCHOOL BREAKFAST PROGRAM, OR BOTH, TEN CENTS (10¢) PER
    30  MEAL SERVED FOR THE 2000-2001 SCHOOL YEAR AND EVERY YEAR

     1  THEREAFTER. FOR THE PURPOSES OF THIS SECTION "SCHOOL" SHALL HAVE
     2  THE SAME MEANING AS GIVEN TO THAT WORD IN 7 CFR 210.2 (RELATING
     3  TO DEFINITIONS).
     4     Section 3 2.  This act shall take effect immediately.          <--
