           MANDERINO, STABACK, THOMAS, YOUNGBLOOD AND WASHINGTON,

                                     AN ACT

     1  Amending the act of April 12, 1951 (P.L.90, No.21), entitled, as
     2     reenacted, "An act relating to alcoholic liquors, alcohol and
     3     malt and brewed beverages; amending, revising, consolidating
     4     and changing the laws relating thereto; regulating and
     5     restricting the manufacture, purchase, sale, possession,
     6     consumption, importation, transportation, furnishing, holding
     7     in bond, holding in storage, traffic in and use of alcoholic
     8     liquors, alcohol and malt and brewed beverages and the
     9     persons engaged or employed therein; defining the powers and
    10     duties of the Pennsylvania Liquor Control Board; providing
    11     for the establishment and operation of State liquor stores,
    12     for the payment of certain license fees to the respective
    13     municipalities and townships, for the abatement of certain
    14     nuisances and, in certain cases, for search and seizure
    15     without warrant; prescribing penalties and forfeitures;
    16     providing for local option, and repealing existing laws,"
    17     providing for an age verification system.

    18     The General Assembly of the Commonwealth of Pennsylvania
    19  hereby enacts as follows:
    20     Section 1.  The act of April 12, 1951 (P.L.90, No.21), known
    21  as the Liquor Code, reenacted and amended June 29, 1987 (P.L.32,
    22  No.14), is amended by adding a section to read:
    23     Section 217.  Age Verification System.--(a)  It is the
    24  purpose of this section to require an accurate identification


     1  system and to provide privacy and confidentiality of information
     2  obtained from an individual's driver's license unless the
     3  individual gives his expressed consent otherwise. The board
     4  shall impose penalties on those who violate this section. This
     5  section shall only apply to licensees as defined in subsection
     6  (d).
     7     (b)  The board shall require any limited licensee that sells
     8  alcoholic beverages for consumption on or off the premises to
     9  install, maintain and use electronic age verification equipment
    10  that scans identification cards and displays the age of the
    11  person as indicated on the card.
    12     (c)  Any limited licensee that fails to comply with this
    13  section commits a violation of this act and shall be subject to
    14  the penalties provided in section 494.
    15     (d)  As used in this section, the following words and phrases
    16  shall have the meanings given to them in this subsection:
    17     "Electronic age verification equipment" shall mean equipment
    18  that electronically reads an identification card and displays
    19  the age of the person identified on the card.
    20     "Limited licensee" shall mean a licensee who has a
    21  restaurant, hotel, malt or brewed beverage license issued by the
    22  board in a city of the first class.
    23     Section 2.  This act shall take effect in 90 days.
