                                     AN ACT

     1  Amending Title 51 (Military Affairs) of the Pennsylvania
     2     Consolidated Statutes, further providing for amount of grants
     3     for educational assistance.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3205(a) of Title 51 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 3205.  Amount of grants.
     9     (a)  Full-time student assistance grants.--Grants awarded
    10  under this chapter to full-time students shall be determined by
    11  the agency without regard to financial need and shall not exceed
    12  for each academic year the lesser of:
    13         (1)  the tuition of the approved institution of higher
    14     learning for the approved program of education in which the
    15     member is enrolled; [or]
    16         (2)  two-thirds of the tuition charged to a resident of
    17     this Commonwealth at a member institution of the State System

     1     of Higher Education for the same academic year[.]; or
     2         (3)  the full tuition charged to a resident of this
     3     Commonwealth at a member institution of the State System of
     4     Higher Education for the same academic year for full-time
     5     students who are also enrolled in officer candidate schools.
     6     (b)  Part-time student assistance grants.--Grants awarded
     7  under this chapter to part-time students shall be determined by
     8  the agency without regard to financial need and shall not exceed
     9  for each academic year or period the lesser of:
    10         (1)  one-half of the tuition for the part-time course of
    11     study in which the member is enrolled; or
    12         (2)  one-third of the tuition charged to a resident of
    13     the Commonwealth at a member institution of the State System
    14     of Higher Education for the same academic year or period.
    15     (c)  Other grants.--The agency shall not reduce the amount of
    16  other agency grants or aid for which the eligible member
    17  qualifies on account of the member's eligibility for or receipt
    18  of grants under this chapter.
    19     (d)  Adjustments.--If the agency and the Adjutant General
    20  determine that the amount appropriated for the program in any
    21  year will be insufficient to provide grants in the amounts set
    22  forth in this section to all eligible members, the agency and
    23  the department may reduce the maximum amount of the grants
    24  proportionately or set a limit on the number of participants to
    25  ensure that sums expended do not exceed appropriations.
    26     Section 2.  This act shall take effect immediately.
