                                     AN ACT

     1  Amending the act of August 26, 1971 (P.L.351, No.91), entitled
     2     "An act providing for a State Lottery and administration
     3     thereof; authorizing the creation of a State Lottery
     4     Commission; prescribing its powers and duties; disposition of
     5     funds; violations and penalties therefor; exemption of prizes
     6     from State and local taxation and making an appropriation,"
     7     further defining "income" for the Pharmaceutical Assistance
     8     Contract for the Elderly program and for the Pharmaceutical
     9     Assistance Contract for the Elderly Needs Enhancement Tier
    10     program.

    11     The General Assembly of the Commonwealth of Pennsylvania
    12  hereby enacts as follows:
    13     Section 1.  The definition of "income" in section 502 of the
    14  act of August 26, 1971 (P.L.351, No.91), known as the State
    15  Lottery Law, added November 21, 1996 (P.L.741, No.134), is
    16  amended to read:
    17  Section 502.  Definitions.
    18     The following words and phrases when used in this chapter


     1  shall have the meanings given to them in this section unless the
     2  context clearly indicates otherwise:
     3     * * *
     4     "Income."  All income from whatever source derived,
     5  including, but not limited to, salaries, wages, bonuses,
     6  commissions, income from self-employment, alimony, support
     7  money, cash public assistance and relief, the gross amount of
     8  any pensions or annuities, including railroad retirement
     9  benefits for calendar years prior to 2003, and 50% of railroad
    10  retirement benefits for calendar years 2003 and thereafter, all
    11  benefits received under the Social Security Act (49 Stat. 620,
    12  42 U.S.C. § 301 et. seq.) (except Medicare benefits) for
    13  calendar years prior to 2003, and 50% of all benefits received
    14  under the Social Security Act (except Medicare benefits) for
    15  calendar years 2003 and thereafter, all benefits received under
    16  State unemployment insurance laws and veterans' disability
    17  payments, all interest received from the Federal Government or
    18  any state government or any instrumentality or political
    19  subdivision thereof, realized capital gains, rentals, workmen's
    20  compensation and the gross amount of loss of time insurance
    21  benefits, life insurance benefits and proceeds, except the first
    22  $5,000 of the total of death benefits payments, and gifts of
    23  cash or property, other than transfers by gift between members
    24  of a household, in excess of a total value of $300, but shall
    25  not include surplus food or other relief in kind supplied by a
    26  government agency or property tax rebate.

    28     Section 2.  This act shall be retroactive to January 1, 2003.
    29     Section 3.  This act shall take effect immediately.
