           HENNESSEY AND BENNINGHOFF, APRIL 29, 1997

                                     AN ACT

     1  Amending the act of June 24, 1931 (P.L.1206, No.331), entitled
     2     "An act concerning townships of the first class; amending,
     3     revising, consolidating, and changing the law relating
     4     thereto," providing for assessment of tapping fees.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 1502 of the act of June 24, 1931
     8  (P.L.1206, No.331), known as The First Class Township Code,
     9  reenacted and amended May 27, 1949 (P.L.1955, No.569), is
    10  amended by adding a clause to read:
    11     Section 1502.  The corporate power of a township of the first
    12  class shall be vested in the board of township commissioners.

    15     LXXVII.  Assessment of tapping fees.  To enact, amend and
    16  repeal ordinances charging certain enumerated fees to property
    17  owners who desire to or are required to connect to any water or
    18  sewer system owned or operated by a municipality, or who desire


     1  to increase their usages of such systems, including connection
     2  fees, customer facility fees and tapping fees, in accordance
     3  with the conditions and restrictions provided in clause (t) of
     4  subsection B of section 4 of the act of May 2, 1945 (P.L.382,
     5  No.164), known as the "Municipality Authorities Act of 1945." No
     6  municipality may charge any tapping, connection or other similar
     7  fee as a condition of connection to a municipally-owned sewer or
     8  water system unless the fee is calculated as provided in the
     9  applicable provisions of the "Municipality Authorities Act of
    10  1945."
    11     Section 2.  This act shall take effect in 60 days.
