| AN ACT |
| |
1 | Amending Title 75 (Vehicles) of the Pennsylvania Consolidated |
2 | Statutes, in penalties and disposition of fines, further |
3 | providing for inability to pay fine and costs. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 6504 of Title 75 of the Pennsylvania |
7 | Consolidated Statutes is amended to read: |
8 | § 6504. Inability to pay fine and costs. |
9 | (a) Order for installment payments.--Upon plea and proof |
10 | that a person is [unable] without the financial means to pay any |
11 | fine and costs imposed under this title, a court may, in |
12 | accordance with 42 Pa.C.S. § 9758 (relating to fine), order |
13 | payment of the fine and costs in installments and shall fix the |
14 | amounts, times and manner of payment. |
15 | (b) Imprisonment for nonpayment.--Any person who does not |
16 | comply with an order entered under this section may be |
17 | imprisoned for a number of days equal to one day for each $40 of |
18 | the unpaid balance of the fine and costs. |

1 | (c) Community service.--Upon plea and proof that a person is |
2 | without the financial means to pay any fine and costs imposed |
3 | under this title, a court may, in accordance with 42 Pa.C.S. § |
4 | 9730 (relating to payment of court costs, restitution and |
5 | fines), order the performance of a reasonable period of |
6 | community service. Court-ordered community service may be |
7 | imposed under this subsection in lieu of payment of up to 50% of |
8 | the fine and costs originally imposed. The court so ordering |
9 | shall fix the duration, time and manner of the performance of |
10 | community service. |
11 | Section 2. This act shall take effect in 60 days. |
