           FABRIZIO, GERGELY, HERMAN, HORSEY, LAUGHLIN, LEH, MARKOSEK,
           MELIO, READSHAW, RUFFING, SHANER, SOLOBAY, WASHINGTON,
           WOJNAROSKI, YOUNGBLOOD AND McNAUGHTON, APRIL 21, 2003

                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, imposing a moratorium on the implementation or
     3     continued use of a vehicle emission inspection program until
     4     certain standards and studies of on-board vehicle emission
     5     diagnostic testing systems are completed.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Title 75 of the Pennsylvania Consolidated
     9  Statutes is amended by adding a section to read:
    10  § 4706.2.  Moratorium on emission inspection program.
    11     Notwithstanding any of the provisions of this chapter or any
    12  law to the contrary, neither the department nor any other
    13  department or agency of the Commonwealth shall continue or
    14  implement any vehicle emission inspection program until the
    15  following occurs:
    16         (1)  The Environmental Protection Agency approves and
    17     issues rules and regulations for the use and implementation
    18     of on-board vehicle emission diagnostic testing systems that


     1     can provide less expensive and more convenient exhaust
     2     checks.
     3         (2)  A joint department and Department of Environmental
     4     Protection emission inspection policy review panel issues
     5     findings and recommendations for the use and implementation
     6     in this Commonwealth of on-board vehicle emission diagnostic
     7     testing systems to the Transportation Committee of the Senate
     8     and the Transportation Committee of the House of
     9     Representatives. Any vehicle emission program currently in
    10     effect shall cease immediately until legislative action can
    11     occur to implement such findings and recommendations.
    12     Section 2.  This act shall take effect in 60 days.
