                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," further providing for
     4     blind pensions.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  The act of June 13, 1967 (P.L.31, No.21), known
     8  as the Public Welfare Code, is amended by adding a section to
     9  read:
    10     Section 506.1.  Computation of Income.--Earned income will be
    11  computed as follows:
    12     (1)  Income which a blind person receives from operating a
    13  business or farm, or practicing a profession, or as an employee
    14  will be designated "earned income." The amount of earned income
    15  available to the blind person will be determined by deducting
    16  expenses necessary to obtain the income. Personal expenses such
    17  as income taxes, social security taxes or occupational taxes

     1  will not be deducted. Allowable expenses from the different
     2  types of earned income are as follows: (i) from gross wages,
     3  commissions and bonuses shall be deducted employment expenses
     4  necessary to the type of job, and not paid by the employer, for
     5  example, the cost of tools, materials, special uniforms or
     6  telephone, the actual cost of transportation to and from
     7  employment and the actual cost of guide service or maintenance
     8  of a guide dog necessary to the employment; (ii) from gross
     9  income from operating a business or farm or practicing a
    10  profession, the actual expenses necessary to produce, protect
    11  and continue the income shall be deducted; (iii) from gross
    12  income received from renting rooms or apartments or furnishing
    13  meals, where the blind person is responsible for providing
    14  service in addition to the use of space and equipment, the
    15  actual expenses necessary to produce, protect and continue the
    16  income shall be deducted.
    17     (2)  If income is derived from renting space or equipment
    18  only, the income will not be considered to be earned income and
    19  the deductions set forth in the Department of Public Welfare
    20  Public Assistance Eligibility Manual regulations shall apply.
    21     Section 2.  This act shall take effect immediately.
