                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     limits on certain costs arising in summary convictions for
     4     motor vehicle cases.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 1725.1(b) of Title 42 of the Pennsylvania
     8  Consolidated Statutes is amended to read:
     9  § 1725.1.  Costs.

    11     (b)  Criminal cases.--The costs to be charged by the minor
    12  judiciary or by the court of common pleas where appropriate in
    13  every criminal case, except as otherwise provided in this
    14  section, shall be as follows:
    15         (1)  Summary conviction, except motor vehicle
    16     cases................................................ $23.50
    17         (2)  Summary conviction, motor vehicles cases,


     1     other than paragraph (3)............................. $17.50
     2         (3)  Summary conviction, motor vehicle cases,
     3     hearing demanded..................................... $22.50
     4         (4)  Misdemeanor................................. $27.50
     5         (5)  Felony...................................... $32.50
     6  Such costs shall include all charges including the costs of
     7  giving a district justice's transcript to the prosecutor or
     8  defendant, or both, if requested. Such costs shall not include,
     9  however, the cost of postage and registered mail which shall be
    10  paid by the defendant upon conviction. The costs imposed in
    11  paragraph (2) shall not, under any circumstances, exceed the
    12  amount of the fine imposed for the violation.
