           SAYLOR, SEMMEL, STABACK, TIGUE AND YOUNGBLOOD, APRIL 29, 2003

                                     AN ACT

     1  Amending the act of May 1, 1933 (P.L.103, No.69), entitled, as
     2     reenacted and amended, "An act concerning townships of the
     3     second class; and amending, revising, consolidating and
     4     changing the law relating thereto," further providing for
     5     shade tree commission members, their appointment, terms and
     6     vacancies.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 2902 of the act of May 1, 1933 (P.L.103,
    10  No.69), known as The Second Class Township Code, is amended to
    11  read:
    12     Section 2902.  Commission Members; Appointment; Terms;
    13  Vacancies.--[A] (a)  Except as provided in subsection (b), a
    14  shade tree commission shall be composed of three members who
    15  shall be residents of the township.
    16     (The] (b)  The board of supervisors may, by ordinance,
    17  provide that the commission be composed of five members who
    18  shall be residents of the township.
    19     (c)  Whenever a shade tree commission of three members is


     1  established by any township, the initial terms of members shall
     2  be for periods of three years, four years and five years
     3  respectively. [All subsequent terms shall be for a period of
     4  five years.] On the expiration of the term of any shade tree
     5  commissioner, a successor shall be appointed by the board to
     6  serve for a term of five years.
     7     (d)  Whenever a shade tree commission of five members is
     8  established by any township, the board of supervisors shall
     9  appoint members to staggered terms so that one term expires
    10  every year. On the expiration of the term of any shade tree
    11  commissioner, a successor shall be appointed by the board to
    12  serve for a term of five years.
    13     (e)  Members of the commission shall serve without
    14  compensation but shall be reimbursed for actual and necessary
    15  expenses incurred in the performance of their duties.
    16     (f)  Vacancies in the office of shade tree commissioner shall
    17  be filled by the board of supervisors for the unexpired term.
    18     Section 2.  This act shall take effect in 60 days.
