AN ACT
1 Amending Title 27 (Environmental Resources) of the Pennsylvania
2 Consolidated Statutes, limiting placement of municipal solid
3 waste or residual waste landfills.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 3112 of Title 27 of the Pennsylvania
7 Consolidated Statutes is amended by adding a subsection to read:
8 § 3112. Plan contents.

10 (e) Siting.--
11 (1) A new municipal waste or residual waste landfill may
12 not be permitted to operate within 2,500 feet of a public
13 watershed.
14 (2) As used in this subsection, the terms "municipal
15 waste" and "residual waste" shall have the meanings given
16 those terms in section 103 of the act of July 28, 1988
1 (P.L.556, No.101), known as the Municipal Waste Planning,
2 Recycling and Waste Reduction Act.
3 Section 2. This act shall take effect in 60 days.
