HOUSE BILL

        INTRODUCED BY LEVDANSKY, WAMBACH, MAINE, VAN HORNE, ANGSTADT,
           GAMBLE, KASUNIC, GRUITZA, BLACK, JADLOWIEC, TANGRETTI, ALLEN,
           COLAIZZO AND WOZNIAK, APRIL 19, 1989

        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           APRIL 24, 1990

                                     AN ACT

     1  Amending the act of June 23, 1931 (P.L.932, No.317), entitled
     2     "An act relating to cities of the third class; and amending,
     3     revising, and consolidating the law relating thereto,"
     4     further providing for the sale of real and personal property.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  The act of June 23, 1931 (P.L.932, No.317), known
     8  as The Third Class City Code, reenacted and amended June 28,
     9  1951 (P.L.662, No.164), is amended by adding a section to read:
    10     Section 1919.  Sales of Real and Personal Property to Certain
    11  Entities.--Any provision of this act requiring advertising for
    12  bids and sale to the highest bidder shall not apply where city
    13  real or personal property is to be sold to a county, city,
    14  borough, town, township, institution district, school district,
    15  volunteer fire company, volunteer ambulance service or volunteer
    16  rescue squad located within the city, or municipal authority
    17  pursuant to the act of May 2, 1945 (P.L.382, No.164), known as
    18  the "Municipality Authorities Act of 1945," is to be sold to a

     1  non-profit NONPROFIT corporation engaged in community industrial  <--
     2  development or where real property is to be sold to a person for  <--
     3  his exclusive use in an industrial development program or where
     4  real property is to be sold to a non-profit NONPROFIT             <--
     5  corporation organized as a public library for its exclusive use
     6  as a library, OR WHERE REAL PROPERTY IS TO BE SOLD TO A           <--
     7  NONPROFIT MEDICAL SERVICE CORPORATION, OR WHERE REAL PROPERTY IS
     8  TO BE SOLD TO A NONPROFIT HOUSING CORPORATION, or where real
     9  property is to be sold to the Commonwealth or to the Federal
    10  Government. When real property is to be sold to a non-profit      <--
    11  NONPROFIT corporation organized as a public library for its       <--
    12  exclusive use as a library, OR TO A NONPROFIT MEDICAL SERVICE     <--
    13  CORPORATION OR TO A NONPROFIT HOUSING CORPORATION, council may
    14  elect to accept such nominal consideration for such sale as it
    15  shall deem appropriate. Real property sold pursuant to this
    16  clause to a volunteer fire company, volunteer ambulance service
    17  or volunteer rescue squad shall be subject to the condition that
    18  when the property is not used for the purposes of the company,
    19  service, squad or the corporation the property shall revert to
    20  the city.
    21     Section 2.  This act shall take effect in 60 days.
