AN ACT 1 Amending the act of July 10, 1989 (P.L.291, No.50), entitled "An 2 act establishing the Philadelphia Regional Port Authority and 3 providing for its powers and duties," providing for criminal 4 history checks and special identification cards in certain 5 circumstances. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. The act of July 10, 1989 (P.L.291, No.50), known 9 as the Philadelphia Regional Port Authority Act, is amended by 10 adding a section to read: 11 Section 22.1. Security. 12 (a) Criminal history checks.--The authority shall implement 13 procedures requiring fingerprint-based criminal history checks 14 for all personnel who work, or who may be expected to work, in 15 conjunction with the loading or offloading of military equipment 16 at the Packer Avenue Marine Terminal or at the Tioga Marine
1 Terminal. 2 (b) Special identification cards.--The authority shall 3 prepare and provide for the use of special identification cards 4 by all personnel who load or offload military equipment at the 5 Packer Avenue Marine Terminal or at the Tioga Marine Terminal. 6 (c) Timing.--Criminal history checks on persons covered by 7 subsection (a) shall be repeated at least once every five years. 8 (d) Cost.--All costs of implementing and complying with the 9 provisions of this section shall be paid by the authority. 10 (e) Prohibition.--No person shall work or be permitted to 11 work for the authority if within the past seven years the person 12 has been convicted in this Commonwealth or elsewhere of 13 violating a Federal or state law which involves: 14 (1) Commission of a felony by means of force. 15 (2) Commission of an act of terrorism. 16 (3) The manufacture, possession, sale, delivery, use or 17 attempted or threatened use of a weapon of mass destruction 18 or a facsimile weapon of mass destruction. 19 (4) Drug trafficking. 20 (5) The sale, manufacture, delivery or possession with 21 intent to sell, manufacture or deliver a controlled 22 substance. 23 (6) The use, threat or attempt to use a firearm while 24 committing or attempting to commit a felony. 25 (7) Theft. 26 (8) Robbery. 27 (9) Receiving stolen property. 28 (10) Any crime an element of which includes use or 29 possession of a firearm. 30 (f) No effect upon union contracts.--Nothing in this section 20050H1257B1483 - 2 -
1 shall be construed to conflict with or abrogate the provisions 2 of any union contract or collective bargaining agreement which 3 is in force on the effective date of this section. 4 (g) Additional security measures.--Nothing in this section 5 shall be construed to prohibit adoption of additional security 6 measures by the authority in accordance with any of the specific 7 powers enumerated in section 6. 8 (h) Implementation of provisions.--The authority shall 9 promulgate such regulations as may be required to implement the 10 provisions of this section. 11 Section 2.
