AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in terms and courses of study,
providing for calculation of average daily membership for a
dual credit course.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 1525.1. Calculation of Average Daily Membership for
a Dual Credit Course.--(a) Notwithstanding 22 Pa. Code ยง 11.5
(relating to part-time attendance for potential graduates) or
any other provision of law, each high school student who is
enrolled in a dual credit course through an institution of
higher education and who does not leave their school entity
during the school day to attend the dual credit course may be
included in the school entity's average daily membership.

(b) As used in this section, the following words and phrases
shall have the meanings given to them in this subsection unless
the context clearly indicates otherwise:
"Dual credit course." A course offered pursuant to a formal
dual-enrollment agreement or partnership between an institution
of higher education and a school entity which permits a student
to earn credit at both the school entity and the institution of
higher education.
"Institution of higher education." An institution located in
this Commonwealth that is authorized to grant an associate or
higher academic degree.
"School entity." A school district, area career and
technical school, charter school, cyber charter school or
regional charter school.
Section 2. This act shall take effect in 60 days.
