AN ACT
1 Restricting transaction fees for automated teller machines.
2 The General Assembly of the Commonwealth of Pennsylvania
3 hereby enacts as follows:
4 Section 1. Short title.
5 This act shall be known and may be cited as the ATM Consumer
6 Protection Act.
7 Section 2. Definitions.
8 The following words and phrases when used in this act shall
9 have the meanings given to them in this section unless the
10 context clearly indicates otherwise:
11 "ATM." An automated teller machine.
12 "Financial institution." Any national bank, State bank,
13 federally chartered savings bank, State-chartered savings bank,
14 federally chartered savings and loan association, federally
15 chartered credit union, State-chartered credit union and any
16 entity that owns or operates an automated teller machine.
1 Section 3. Fee restrictions.
2 No customer shall be liable to pay any fee or surcharge to
3 any financial institution for an ATM transaction initiated at an
4 ATM or initiated via telephone.
5 Section 4. Effective date.
6 This act shall take effect in 30 days.
