                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, authorizing suspension of operating
     3     privilege for certain prostitution offenses.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 5902 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended by adding subsections to read:
     8  § 5902.  Prostitution and related offenses.
     9     * * *
    10     (e.2)  Operating privilege suspension.--The Department of
    11  Transportation shall suspend the operating privilege of any
    12  person upon receiving a certified record of a driver's
    13  conviction under this section. The duration of the suspension
    14  shall be as follows:
    15         (1)  For a first offense, the department shall impose a
    16     suspension for a period of 60 days.
    17         (2)  For a second offense, the department shall impose a
    18     suspension for a period of 180 days.

     1         (3)  For a third offense, the department shall impose a
     2     suspension for a period of one year.
     3         (4)  For a fourth and subsequent offense, the department
     4     shall impose a suspension for a period of two years. Any
     5     multiple suspensions imposed shall be served consecutively.
     6  The court shall provide the department with a certified record
     7  of any person convicted under this section.
     8     (e.3)  Limited license.--Any person whose license is
     9  suspended under this section may qualify for an occupational
    10  limited license. The person must meet and follow requirements
    11  set forth in 75 Pa.C.S. § 1553 (relating to occupational limited
    12  license) in applying and using an occupational limited license.
    13  Those convicted of a fourth and subsequent offense shall not
    14  qualify for an occupational limited license.
    15     (e.4)  Reduction of suspension.--A person whose operating
    16  privilege is suspended under this section may elect to reduce
    17  the period of suspension imposed by the court by performing
    18  court-authorized community service. The period of suspension
    19  ordered by the court shall be reduced at the rate of one day for
    20  each hour of community service performed, for a maximum
    21  reduction in suspension of 30 days for those convicted of a
    22  first offense and 90 days for those convicted of a second
    23  offense. Those convicted of third or subsequent offenses shall
    24  not qualify for community service allowance. The court must
    25  approve any community service plan and have final oversight on
    26  whether the person adequately performed the community service.
    27  The court shall notify the department that the person performed
    28  the community service and shall order a reduction in suspension.
    29     (e.5)  Reinstatement of operating privileges.--Reinstatement
    30  of operating privileges shall be in accordance with 75 Pa.C.S. §
    19990H1270B1460                  - 2 -

     1  1545 (relating to restoration of operating privilege).
     2     (e.6)  Additional penalties.--The provisions for suspension
     3  of operating privileges or performance of community service
     4  pursuant to this section shall be in addition to any other
     5  penalties imposed upon conviction of this section.

     7     Section 2.  This act shall take effect in 60 days.
