AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES, JUNE 6, 1989
AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, increasing the penalty for certain parking 3 violations relating to handicapped and disabled veterans' 4 parking spaces; AND AUTHORIZING HANDICAPPED PERSONS AND <-- 5 DISABLED VETERANS TO ISSUE CERTAIN WARNINGS. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Section 3354(E) AND (f) of Title 75 of the <-- 9 Pennsylvania Consolidated Statutes is ARE amended to read: <-- 10 § 3354. Additional parking regulations. 11 * * * 12 (E) UNAUTHORIZED USE.-- <-- 13 (1) AN OPERATOR OF A VEHICLE BEARING A HANDICAPPED OR 14 SEVERELY DISABLED VETERAN PLATE OR DISPLAYING A HANDICAPPED 15 OR SEVERELY DISABLED VETERAN PARKING PLACARD SHALL NOT MAKE 16 USE OF THE PARKING PRIVILEGES ACCORDED TO HANDICAPPED PERSONS
1 AND SEVERELY DISABLED VETERANS UNDER SUBSECTION (D)(3) UNLESS 2 THE OPERATOR IS HANDICAPPED OR A SEVERELY DISABLED VETERAN OR 3 UNLESS THE VEHICLE IS BEING OPERATED FOR THE TRANSPORTATION 4 OF A HANDICAPPED PERSON OR SEVERELY DISABLED VETERAN. 5 (2) HANDICAPPED PERSONS AND DISABLED VETERANS ARE 6 AUTHORIZED TO ISSUE WARNINGS TO VIOLATORS OR VIOLATING 7 VEHICLES FOR VIOLATIONS OF THIS SUBSECTION, IN ACCORDANCE 8 WITH THE REGULATIONS OF THE DEPARTMENT PROMULGATED TO 9 IMPLEMENT THIS PARAGRAPH. 10 (f) Penalty.--Any person violating subsection (a), (b) or 11 (d)(1) is guilty of a summary offense and shall, upon 12 conviction, be sentenced to pay a fine of not more than $15. Any 13 person violating subsection (d)(2) or (3) or (e) is guilty of a 14 summary offense and shall, upon conviction, be sentenced to pay 15 a fine of not less than [$15] $100 nor more than [$50] $200. 16 Section 2.
