                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, increasing the penalty for certain parking
     3     violations relating to handicapped and disabled veterans'
     4     parking spaces; and authorizing LOCAL AUTHORITIES TO PERMIT    <--
     5     handicapped persons and disabled veterans to issue certain
     6     warnings NOTICES.                                              <--

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 3354(e) 3354(D)(3) and (f) of Title 75 of  <--
    10  the Pennsylvania Consolidated Statutes are amended to read:
    11  § 3354.  Additional parking regulations.

    13     (e)  Unauthorized use.--                                       <--
    14         (1)  An operator of a vehicle bearing a handicapped or
    15     severely disabled veteran plate or displaying a handicapped
    16     or severely disabled veteran parking placard shall not make


     1     use of the parking privileges accorded to handicapped persons
     2     and severely disabled veterans under subsection (d)(3) unless
     3     the operator is handicapped or a severely disabled veteran or
     4     unless the vehicle is being operated for the transportation
     5     of a handicapped person or severely disabled veteran.
     6         (2)  Handicapped persons and disabled veterans are
     7     authorized to issue warnings to violators or violating
     8     vehicles for violations of this subsection, in accordance
     9     with the regulations of the department promulgated to
    10     implement this paragraph.
    11     (D)  HANDICAPPED PERSONS AND DISABLED VETERANS.--              <--

    13         (3)  (I)  EXCEPT FOR PERSONS PARKING VEHICLES LAWFULLY
    14         BEARING A HANDICAPPED OR SEVERELY DISABLED VETERAN
    15         REGISTRATION PLATE OR DISPLAYING A HANDICAPPED OR
    16         SEVERELY DISABLED VETERAN PARKING PLACARD WHEN SUCH
    17         VEHICLES ARE BEING OPERATED BY OR FOR THE TRANSPORTATION
    18         OF A HANDICAPPED PERSON OR A SEVERELY DISABLED VETERAN,
    19         NO PERSON SHALL PARK A VEHICLE ON PUBLIC OR PRIVATE
    20         PROPERTY RESERVED FOR A HANDICAPPED PERSON OR SEVERELY
    21         DISABLED VETERAN WHICH PROPERTY HAS BEEN SO POSTED IN
    22         ACCORDANCE WITH DEPARTMENTAL REGULATIONS.
    23             (II)  LOCAL AUTHORITIES SHALL HAVE THE POWER AND MAY,
    24         BY ORDINANCE OR RESOLUTION, AUTHORIZE HANDICAPPED PERSONS
    25         AND DISABLED VETERANS TO ISSUE NOTICES TO VIOLATORS OR
    26         VIOLATING VEHICLES FOR VIOLATION OF SUBPARAGRAPH (I). THE
    27         NOTICE SHALL BE AS PRESCRIBED BY THE LOCAL AUTHORITIES.

    29     (f)  Penalty.--Any person violating subsection (a), (b) or
    30  (d)(1) is guilty of a summary offense and shall, upon

     1  conviction, be sentenced to pay a fine of not more than $15. Any
     2  person violating subsection (d)(2) or (3) or (e) is guilty of a
     3  summary offense and shall, upon conviction, be sentenced to pay
     4  a fine of not less than [$15] $100 $50 nor more than [$50] $200.  <--
     5     Section 2.  This act shall take effect in 60 days.
