        AS AMENDED ON SECOND CONSIDERATION, IN SENATE, APRIL 30, 1990

                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, FURTHER PROVIDING FOR EXEMPTION FROM REGISTRATION    <--
     3     FEES; increasing the penalty for certain parking violations
     4     relating to handicapped and disabled veterans' parking
     5     spaces; and authorizing LOCAL AUTHORITIES TO PERMIT            <--
     6     handicapped persons and disabled veterans to issue certain
     7     warnings NOTICES STATEMENTS.                                   <--

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     SECTION 1.  SECTION 1901(C) OF TITLE 75 OF THE PENNSYLVANIA    <--
    11  CONSOLIDATED STATUTES IS AMENDED BY ADDING PARAGRAPHS TO READ:
    12  § 1901.  EXEMPTION OF ENTITIES AND VEHICLES FROM FEES.
    13     * * *
    14     (C)  PROCESSING FEE IN LIEU OF REGISTRATION FEE.--NO
    15  REGISTRATION FEE SHALL BE CHARGED FOR VEHICLES REGISTERED BY ANY
    16  OF THE FOLLOWING BUT THE DEPARTMENT SHALL CHARGE A FEE OF $10 TO
    17  COVER THE COSTS OF PROCESSING FOR ISSUING OR RENEWING THE


     1  REGISTRATION:
     2         * * *
     3         (20)  NONPROFIT ORGANIZATIONS WHICH CARE FOR OR OTHERWISE
     4     PROVIDE SERVICES FOR THE ELDERLY OR THE INFIRM.
     5         (21)  NONPROFIT ORGANIZATIONS WHICH PRINCIPALLY SERVE
     6     MENTALLY OR PHYSICALLY HANDICAPPED OR DISABLED PERSONS.

     8     Section 1 2.  Section 3354(e) 3354(D)(3) and (f) of Title 75   <--
     9  of the Pennsylvania Consolidated Statutes are amended to read:    <--
    10  § 3354.  Additional parking regulations.
    11     * * *
    12     (e)  Unauthorized use.--                                       <--
    13         (1)  An operator of a vehicle bearing a handicapped or
    14     severely disabled veteran plate or displaying a handicapped
    15     or severely disabled veteran parking placard shall not make
    16     use of the parking privileges accorded to handicapped persons
    17     and severely disabled veterans under subsection (d)(3) unless
    18     the operator is handicapped or a severely disabled veteran or
    19     unless the vehicle is being operated for the transportation
    20     of a handicapped person or severely disabled veteran.
    21         (2)  Handicapped persons and disabled veterans are
    22     authorized to issue warnings to violators or violating
    23     vehicles for violations of this subsection, in accordance
    24     with the regulations of the department promulgated to
    25     implement this paragraph.
    26     (D)  HANDICAPPED PERSONS AND DISABLED VETERANS.--              <--

    28         (3)  (I)  EXCEPT FOR PERSONS PARKING VEHICLES LAWFULLY
    29         BEARING A HANDICAPPED OR SEVERELY DISABLED VETERAN
    30         REGISTRATION PLATE OR DISPLAYING A HANDICAPPED OR

     1         SEVERELY DISABLED VETERAN PARKING PLACARD WHEN SUCH
     2         VEHICLES ARE BEING OPERATED BY OR FOR THE TRANSPORTATION
     3         OF A HANDICAPPED PERSON OR A SEVERELY DISABLED VETERAN,
     4         NO PERSON SHALL PARK A VEHICLE ON PUBLIC OR PRIVATE
     5         PROPERTY RESERVED FOR A HANDICAPPED PERSON OR SEVERELY
     6         DISABLED VETERAN WHICH PROPERTY HAS BEEN SO POSTED IN
     7         ACCORDANCE WITH DEPARTMENTAL REGULATIONS.
     8             (II)  LOCAL AUTHORITIES SHALL HAVE THE POWER AND MAY,
     9         BY ORDINANCE OR RESOLUTION, AUTHORIZE HANDICAPPED PERSONS
    10         AND SEVERELY DISABLED VETERANS TO ISSUE NOTICES            <--
    11         STATEMENTS TO VIOLATORS OR VIOLATING VEHICLES FOR          <--
    12         VIOLATION OF SUBPARAGRAPH (I). THE NOTICE FORM OF THE      <--
    13         STATEMENT SHALL BE AS PRESCRIBED BY THE LOCAL
    14         AUTHORITIES.
    15     * * *
    16     (f)  Penalty.--Any person violating subsection (a), (b) or
    17  (d)(1) is guilty of a summary offense and shall, upon
    18  conviction, be sentenced to pay a fine of not more than $15. Any
    19  person violating subsection (d)(2) or (3) or (e) is guilty of a
    20  summary offense and shall, upon conviction, be sentenced to pay
    21  a fine of not less than [$15] $100 $50 nor more than [$50] $200.  <--
    22     Section 2 3.  This act shall take effect in 60 days.           <--
