                                     AN ACT

     1  Amending Title 34 (Game) of the Pennsylvania Consolidated
     2     Statutes, further providing an exception for disturbance of
     3     game or wildlife.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 2162 of Title of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 2162.  Disturbance of game or wildlife.
     9     (a)  General rule.--It is unlawful for any person to drive or
    10  disturb game or wildlife except while engaged in the lawful
    11  activities set forth in this title.
    12     (b)  Nonapplicability.--This section shall not apply to
    13  [any]:
    14         (1)  Any owner of land, any member of the commission, the
    15     director, any representative of the commission or any other
    16     law enforcement officer engaged in any otherwise lawful
    17     action.

     1         (2)  Any operator of a motor vehicle who utilizes the
     2     vehicle horn or approved audible warning device to facilitate
     3     the movement of game or wildlife from any highway including
     4     the shoulders of that highway.
     5     (c)  Penalty.--A violation of subsection (a) shall be a
     6  summary offense of the first degree.
     7     Section 2.  This act shall be retroactive to January 1, 2001.
     8     Section 3.  This act shall take effect immediately.
