AN ACT

 

1Amending Title 53 (Municipalities Generally) of the Pennsylvania
2Consolidated Statutes, in neighborhood blight reclamation and
3revitalization, providing for divestiture of tax claims and
4municipal liens upon agreement of governing bodies.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 6141 of Title 53 of the Pennsylvania
8Consolidated Statutes is amended to read:

9§ 6141. [(Reserved).] Divestiture of tax claims and municipal 
10liens upon agreement of majority of governing bodies.

11(a) General rule.--A majority of the governing bodies of a
12county, municipality and school district that levy real property
13taxes on a property regarded as a public nuisance and targeted
14for demolition may petition the court of common pleas for the
15county in which the property is situated to divest all county,
16municipal and school district tax claims and municipal liens
17against the property if the governing body of each county,
18municipality or school district represented in the majority have

1adopted a resolution indicating that governing body's approval
2of the divestiture of its tax claims and municipal liens against
3the property and of the filing of the petition.

4(b) Attorney fees and court costs.--If not all of the
5governing bodies of the county, municipality and school district
6that levy real property taxes on the property have adopted a
7resolution authorized under subsection (a), then the court shall
8award attorney fees and court costs to the governing bodies that
9represent the majority of the governing bodies which filed the
10petition.

11Section 2. This act shall take effect in 60 days.
