AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," requiring State agencies to 21 use recycled paper. 22 The General Assembly of the Commonwealth of Pennsylvania 23 hereby enacts as follows: 24 Section 1. The act of April 9, 1929 (P.L.177, No.175), known 25 as The Administrative Code of 1929, is amended by adding
1 sections to read: 2 Section 529. Recycled Paper Products.--(a) All State 3 agencies and departments, including, but not limited to, the 4 Department of General Services, with procurement authority 5 shall, to the fullest extent possible when contracting for paper 6 or paper products, purchase in graduated amounts only such paper 7 or paper products that are manufactured or produced from 8 recycled paper. 9 (b) The provisions of subsection (a) shall be implemented by 10 every State agency or department, including, but not limited to, 11 the Department of General Services, with procurement authority 12 so that of the total volume of paper purchased, recycled paper 13 composes at least ten per centum (10%) of the volume in 1989, at 14 least twenty-five per centum (25%) of the volume in 1991 and at 15 least fifty per centum (50%) of the volume in 1993. 16 (c) As used in this section, the following words and phrases 17 shall have the meanings given to them in this subsection: 18 "Postconsumer waste" means any product generated by a 19 business on consumer which has served its intended end use, and 20 which has been separated from solid waste for the purposes of 21 collection, recycling and disposition and which does not include 22 secondary waste material or demolition waste. 23 "Recycled paper" means any paper having a total weight 24 consisting of not less than twenty per centum (20%) secondary 25 waste paper material in 1989, not less than thirty per centum 26 (30%) of said material in 1990, not less than forty per centum 27 (40%) of said material in 1993, and not less than fifty per 28 centum (50%) of said material in 1996 and thereafter, and not 29 less than ten percentum (10%) postconsumer waste beginning in 30 1996. 19890H1314B1517 - 2 -
1 "Secondary waste paper material" means paper waste generated 2 after the completion of a papermaking process, such as 3 postconsumer waste material, envelope cuttings, binder, 4 trimmings, printing waste, cutting and other converting waste, 5 butt rolls and mill wrappers. The term shall not include fibrous 6 waste generated during the manufacturing process, such as fibers 7 recovered from wastewater or trimmings of paper machine rolls, 8 fibrous by-products of harvesting, extractive or woodcutting 9 process, for forest residue such as bark. 10 Section 2410.1. Advertisements for Bids; Statement of 11 Preference for Recycled Paper or Paper Products; Purchasing 12 Practices.--(a) In advertising for bids for recycled paper or 13 paper products under section 529, all State agencies and 14 departments, including, but not limited to, the Department of 15 General Services, with procurement authority shall give 16 preference wherever feasible to the purchase of recycled paper 17 or paper products. 18 (b) All State agencies and departments, including, but not 19 limited to, the Department of General Services, shall give 20 preference to suppliers of recycled paper or paper products. 21 This preference shall be five per centum (5%) of the lowest bid 22 or price quoted by suppliers offering nonrecycled paper or paper 23 products. 24 (c) All State agencies and departments, including, but not 25 limited to, the Department of General Services, shall review and 26 revise at least annually their procurement procedures and 27 specifications for purchasing recycled paper and paper products. 28 (d) All suppliers to the Commonwealth of recycled paper or 29 paper products must certify to the contracting officer that the 30 material offered contains the minimum percentage of recycled 19890H1314B1517 - 3 -
1 paper required by section 529.
2 Section 2. This act shall take effect immediately.
