AN ACT

Authorizing municipalities and the Department of Environmental

2

Protection to conduct sewage sludge testing on certain lands;

3

and providing for reports to the General Assembly.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Short title.

7

This act shall be known and may be cited as the Sewage Sludge

8

Testing Act.

9

Section 2.  Definitions.

10

The following words and phrases when used in this act shall

11

have the meanings given to them in this section unless the

12

context clearly indicates otherwise:

13

"Department."  The Department of Environmental Protection of

14

the Commonwealth.

15

Section 3.  Sewage sludge testing.

16

(a)  Authorization to municipalities.--A municipality may

adopt an ordinance or resolution authorizing the municipality to

2

conduct tests of land for the application of sewage sludge and

3

providing that the expense of the tests shall be paid by:

4

(1)  the entity that applied the sewage sludge;

5

(2)  the owner of the land; or

6

(3)  the transporter of the sewage sludge.

(b)  Authorization to department.--Upon written complaint of

8

any person, the department may enter upon any land in this

9

Commonwealth and conduct tests of the land for the application

10

of sewage sludge without prior notice to the owner of the land.

11

Section 4.  Reports.

12

The department shall submit an annual report to the General

13

Assembly on the complaints received and the testing conducted by

14

the department under this act.

Section 5.  Effective date.

16

This act shall take effect in 60 days.
