                                     AN ACT

     1  Providing for radon testing in public buildings; conferring
     2     powers and duties on the Department of Environmental
     3     Resources; and making an appropriation.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Short title.
     7     This act shall be known and may be cited as the Public
     8  Building Radon Detection Act.
     9  Section 2.  Definitions.
    10     The following words and phrases when used in this act shall
    11  have the meanings given to them in this section unless the
    12  context clearly indicates otherwise:
    13     "Department."  The Department of Environmental Resources of
    14  the Commonwealth.
    15     "Public building."  A building owned or leased by the
    16  Commonwealth or a political subdivision.


     1  Section 3.  Program.
     2     (a)  Testing.--The department shall test all public buildings
     3  for the presence of radon. Testing shall consist of two tests in
     4  a one-year period, one test during the winter months and one
     5  test during the summer months. Testing shall be done on all
     6  ground floors and below-ground floors. Test results of 4 pCi/1
     7  are acceptable. Test results exceeding 4 pCi/1 require retesting
     8  within one month. Retest results exceeding 4 pCi/1 indicate a
     9  health risk. Each building shall be tested every five years.
    10  Testing shall consist of two tests in a one-year period, one
    11  test during the winter months and one test during the summer
    12  months.
    13     (b)  Results.--Test results under subsection (a) shall be
    14  transmitted to the governmental entity that is in control of the
    15  building. Test results under subsection (a) are public records.
    16  Test results under subsection (a) shall be maintained by the
    17  department for five years and shall be available for public
    18  inspection.
    19     (c)  Exemption.--A public building that has been tested by
    20  the department prior to the effective date of this section shall
    21  be exempt from this act unless the department determines, by
    22  adjudication, that it is necessary to continue testing under
    23  this act.
    24  Section 4.  Regulations.
    25     The department shall promulgate regulations to administer
    26  this act.
    27  Section 5.  Appropriation.
    28     The sum of $3,000,000, or as much thereof as may be
    29  necessary, is hereby appropriated to the Department of
    30  Environmental Resources for the fiscal year July 1, 1988, to

     1  June 30, 1989, to carry out the provisions of this act.
     2  Section 6.  Effective date.
     3     This act shall take effect as follows:
     4         (1)  Section 4 and this section shall take effect
     5     immediately.
     6         (2)  The remainder of this act shall take effect in 90
     7     days.
