                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, imposing a moratorium on the implementation or
     3     continued use of a vehicle emission inspection program until
     4     certain standards and studies of on-board vehicle emission
     5     diagnostic testing systems are completed.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Title 75 of the Pennsylvania Consolidated
     9  Statutes is amended by adding a section to read:
    10  § 4706.2.  Moratorium on emission inspection program.
    11     (a)  General rule.--Notwithstanding any of the provisions of
    12  this chapter or any law to the contrary, all vehicle emission
    13  inspection programs shall cease immediately until the following
    14  occur:
    15         (1)  The Environmental Protection Agency approves and
    16     issues rules and regulations for the use and implementation
    17     of on-board vehicle emission diagnostic testing systems that
    18     can provide less expensive and more convenient exhaust

     1     checks.
     2         (2)  A joint department and Department of Environmental
     3     Protection emission inspection policy review panel issues
     4     findings and recommendations for the use and implementation
     5     in this Commonwealth of on-board vehicle emission diagnostic
     6     testing systems to the Transportation Committee of the Senate
     7     and the Transportation Committee of the House of
     8     Representatives.
     9         (3)  Such findings and recommendations are enacted into
    10     law.
    11     (b)  Notice.--When the conditions required under subsection
    12  (a) are satisfied, the department shall publish a notice thereof
    13  in the Pennsylvania Bulletin.
    14     Section 2.  This act shall take effect in 60 days.
