                                     AN ACT

     1  Amending the act of June 27, 1947 (P.L.1046, No.447), entitled,
     2     as amended, "An act providing for equalization of assessed
     3     valuations of real property throughout the Commonwealth for
     4     use in determining the amount and allocation of Commonwealth
     5     subsidies to school districts; providing for the establishing
     6     of a common level ratio for each county; creating a State Tax
     7     Equalization Board; and prescribing its powers and duties;
     8     imposing duties on certain local officers, agents, boards,
     9     commissions and departments; and making an appropriation,"
    10     further providing for the use of the common level ratio by
    11     counties.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Section 7(9) of the act of June 27, 1947
    15  (P.L.1046, No.447), referred to as the State Tax Equalization
    16  Board Law, added December 13, 1982 (P.L.1158, No.267), is
    17  amended to read:
    18     Section 7.  General Powers and Duties of the Board.--The
    19  board shall have the power and its duties shall be--
    20     * * *
    21     (9)  To establish, annually, prior to July 1, a common level
    22  ratio of assessed value to market value in each county for the


     1  prior calendar year. Notwithstanding any other act to the
     2  contrary, no county shall be permitted to use the common level
     3  ratio in determination of new assessments or appeals unless that
     4  county has completed a countywide reassessment of all county
     5  property within the preceding five calendar years. When the
     6  common level ratio cannot be used, valuations for new
     7  assessments shall be determined by using the value of comparable
     8  property from the county's base year.
     9     Section 2.  This act shall take effect immediately.
