                                     AN ACT

     1  Amending the act of December 22, 1983 (P.L.303, No.83), entitled
     2     "An act relating to destruction of pet animals; prohibiting
     3     certain methods of destruction; providing for a limited
     4     license to dispense certain drugs; providing for regulation
     5     and enforcement; providing for use of certain surplus funds;
     6     and providing penalties," prohibiting the use of animals for
     7     certain purposes.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The act of December 22, 1983 (P.L.303, No.83),
    11  referred to as the Animal Destruction Method Authorization Law,
    12  is amended by adding a section to read:
    13  Section 8.1.  Prohibited use of animals.
    14     (a)  Custody by humane society.--No animal, dead or alive, or
    15  any part of an animal in the custody of any humane society or
    16  animal control organization may be sold or made available for
    17  the purpose of, but not limited to, testing, medical or
    18  scientific teaching or demonstration, research or
    19  experimentation.

     1     (b)  Purchase for experimentation.--No person may purchase or
     2  accept an animal, dead or alive, or any part of an animal in the
     3  custody of any humane society or animal control organization
     4  within the Commonwealth for the purpose of, but not limited to,
     5  testing, medical or scientific teaching or demonstration,
     6  research or experimentation.
     7     (c)  Authorized disposition of animals.--Each animal in the
     8  custody of any humane society or animal control organization
     9  shall be:
    10         (1)  returned to its owner upon being reclaimed;
    11         (2)  adopted by a qualifying individual; or
    12         (3)  destroyed as provided for in this act.
    13     (d)  Application of section.--
    14         (1)  This section shall not apply to the transfer of
    15     animals from a humane society or animal shelter to an
    16     institutional medical program in which care and treatment of
    17     animals is provided by licensed animal health care
    18     practitioners and trainees under their supervision, and in
    19     which animals are returned to the custodial shelter or humane
    20     society for adoption upon completion of treatment.
    21         (2)  Nothing in this section shall prohibit the
    22     acquisition of animals for the purpose of testing, medical or
    23     scientific teaching or demonstration, research or
    24     experimentation from any other legal source.
    25     Section 2.  Section 9 of the act is amended to read:
    26  Section 9.  Penalty.
    27     Any person or organization found guilty of violating the
    28  provisions of this act shall be fined not to exceed [$250] $300
    29  per violation day.
    30     Section 3.  This act shall take effect immediately.
