AS AMENDED ON THIRD CONSIDERATION, IN SENATE, NOVEMBER 25, 2002
AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," further providing for <-- 21 furnishing lists of employees to certain State officers; and <-- 22 THE CONTENTS OF LISTS OF COMMONWEALTH EMPLOYEES; AND <-- 23 exempting certain persons from Federal law relating to public 24 assistance. 25 The General Assembly of the Commonwealth of Pennsylvania 26 hereby enacts as follows: 27 Section 1. Section 614(a) and (c) of the act of April 9, <--
1 1929 (P.L.177, No.175), known as The Administrative Code of 2 1929, amended November 26, 1997 (P.L.530, No.57), is ARE amended <-- 3 to read: 4 Section 614. List of Employes to be Furnished to Certain 5 State Officers.--(a) All administrative departments, boards, 6 and commissions and the Attorney General shall on July 15 of 7 each year, transmit to the Auditor General, the State Treasurer 8 and Secretary of the Budget a complete list, and to the 9 Legislative Data Processing Center a computer tape of such list, 10 as of July 1 preceding, of the names of all persons, except day- 11 laborers, entitled to receive compensation from the Commonwealth 12 for services rendered in or to the department, board, or 13 commission, as the case may be. Such list shall show FOR EACH <-- 14 SUCH PERSON the position occupied [by each such person, the], <-- 15 date of birth [and], COUNTY OF RESIDENCE, voting residence [of <-- 16 such person], the salary at which or other basis upon which such <-- 17 person is entitled to be paid, the date [when such person <-- 18 entered] OF ENTRY INTO the service of the Commonwealth, whether <-- 19 such person has been continuously employed by the Commonwealth 20 since that date, and all periods of service and positions held 21 as an employe of the Commonwealth, or such part of such 22 information RELATED TO PREVIOUS SERVICE AND POSITIONS as the <-- 23 Governor may prescribe. Notwithstanding the preceding <-- 24 requirement, the lists of persons furnished by the Department of 25 Corrections, the Board of Probation and Parole and the Pardons 26 Board shall also list the county of residence of each person. 27 * * * 28 (c) The information received by the Auditor General, the 29 State Treasurer and the Secretary of the Budget, under this 30 section, shall be public information[.], except that the 20010H1401B4695 - 2 -
1 information identifying the voting residence of the persons 2 furnished by the Department of Corrections, the Board of <-- 3 Probation and Parole and the Pardons Board EMPLOYED BY THE <-- 4 COMMONWEALTH is not SHALL NOT BE public information and may not <-- 5 be treated as such. 6 Section 2. Section 2301 of the act, amended July 13, 1957 7 (P.L.852, No.390), is amended to read: 8 SECTION 1. SECTION 2301 OF THE ACT OF APRIL 9, 1929 <-- 9 (P.L.177, NO.175), KNOWN AS "THE ADMINISTRATIVE CODE OF 1929," 10 AMENDED JULY 13, 1957 (P.L.852, NO.390), IS AMENDED TO READ: 11 Section 2301. Powers and Duties in General.--(a) The 12 Department of Public Welfare shall, subject to any inconsistent 13 provisions in this act contained, continue to exercise the 14 powers and perform the duties by law vested in and imposed upon 15 the said department, the Secretary of Public Welfare, and the 16 former Department of Public Welfare, and Commissioner of Public 17 Welfare, and the former Department of Welfare. 18 (b) Pursuant to the authorization provided to the states 19 under the Personal Responsibility and Work Opportunity 20 Reconciliation Act of 1996 (Public Law 104-193, 21 U.S.C. § 21 862a(d)(1)(A)), Pennsylvania elects to exempt all individuals 22 domiciled in the State from application of 21 U.S.C. § 862a(a). 23 After approval of benefits, the department shall refer all 24 affected individuals for assessment and treatment under the act 25 of April 14, 1972 (P.L.221, No.63), known as the "Pennsylvania 26 Drug and Alcohol Abuse Control Act." This subsection shall not 27 be construed to alter or supersede the provisions of section 28 405.1 of the act of June 13, 1967 (P.L.31, No.21), known as the 29 "Public Welfare Code." 30 Section 3.
