                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for child safety locks for
     3     firearms.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Chapter 61 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a subchapter to read:
     8                           SUBCHAPTER B.1
     9                         CHILD SAFETY LOCKS
    10  6131.  Short title of subchapter.
    11  6132.  Definitions.
    12  6133.  Violations.
    13  6134.  Exceptions.
    14  6135.  Penalties.
    15  § 6131.  Short title of subchapter.
    16     This subchapter shall be known and may be cited as the Child

     1  Safety Lock Act.
     2  § 6132.  Definitions.
     3     The following words and phrases when used in this subchapter
     4  shall have the meanings given to them in this section unless the
     5  context clearly indicates otherwise:
     6     "Licensee."  Any licensed manufacturer, importer or dealer of
     7  firearms.
     8     "Locking device."  A device that, if installed on a firearm
     9  and secured by means of a key or a mechanically, electronically
    10  or electromechanically operated combination lock, prevents the
    11  firearm from being discharged without first deactivating or
    12  removing the device or a locking mechanism incorporated into the
    13  design of a firearm that prevents discharge of the firearm by
    14  any person who does not have access to the key or other device
    15  designed to unlock the mechanism.
    16  § 6133.  Violations.
    17     It shall be unlawful for any licensee to sell, deliver or
    18  transfer any handgun to any person other than another licensee
    19  unless the transferee is provided with a locking device for that
    20  firearm.
    21  § 6134.  Exceptions.
    22     Firearms for transfer to or possession by any law enforcement
    23  officer employed by any Federal, State or local government
    24  entity or rail police employed and certified by a rail carrier
    25  as a police officer are not subject to the provisions of this
    26  subchapter.
    27  § 6135.  Penalties.
    28     Failure to comply with the provisions of this subchapter may
    29  result in:
    30         (1)  Suspension or revocation of any license issued to a

     1     licensee.
     2         (2)  A civil penalty for any licensee in an amount equal
     3     to but not more than $10,000.
     4     Section 2.  This act shall take effect in 90 days.
