        INTRODUCED BY HANNA, BRENNAN, MAHONEY, SIPTROTH, STABACK,
           SOLOBAY, CALTAGIRONE, CONKLIN, CAUSER, PETRONE, BARRAR,
           THOMAS, DeLUCA AND JAMES, JUNE 1, 2007

        AS AMENDED ON SECOND CONSIDERATION, HOUSE OF REPRESENTATIVES,
           JULY 12, 2007

                                     AN ACT

     1  Amending Title 3 (Agriculture) of the Pennsylvania Consolidated
     2     Statutes, defining ADDING DEFINITIONS OF "CERTIFIED PARKING    <--
     3     METER INSPECTOR" AND "local government unit"; and providing
     4     for CERTIFIED PARKING METER INSPECTORS AND FOR general         <--
     5     testing and inspections.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 4102 of Title 3 of the Pennsylvania
     9  Consolidated Statutes is amended by adding a definition to read:
    10  § 4102.  Definitions.
    11     The following words and phrases when used in this chapter
    12  shall have the meanings given to them in this section unless the
    13  context clearly indicates otherwise:

    15     "CERTIFIED PARKING METER INSPECTOR."  AN INDIVIDUAL WHO IS     <--
    16  CERTIFIED BY THE DEPARTMENT OF AGRICULTURE TO INSPECT AND
    17  CERTIFY THE ACCURACY OF PARKING METERS.

     1     "Local government unit."  Any city, borough, township or town
     2  or any home rule municipality, optional charter municipality or
     3  similar general purpose unit of government which may be created
     4  or authorized by statute.

     6     Section 2.  Section 4112 of Title 3 is amended by adding a
     7  subsection to read:
     8  § 4112.  General testing and inspections.
     9     * * *
    10     (b.1)  Local government unit inspection of parking meters.--
    11  Notwithstanding subsections (a) and (b), if a local government
    12  unit or authority organized by a local government unit makes
    13  commercial use of parking meters, it shall be the duty of the     <--
    14  local government unit or the appropriate authority at least once
    15  within a 36-month 60-MONTH period, or more frequently if deemed   <--
    16  necessary by the local government unit or authority responsible
    17  for conducting the inspections, to assure that all such
    18  commercially used parking meters are inspected and tested to      <--
    19  ascertain if they are correct. The local government unit or
    20  appropriate authority may accept reports of Certified Examiners   <--
    21  of Weights and Measures as sufficient to meet the inspection and
    22  testing requirements of this subsection if:
    23         (1)  the inspection and testing is performed in
    24     accordance with all applicable standards and procedures
    25     adopted under section 4110(a)(4); and
    26         (2)  State inspectors of weights and measures conduct
    27     inspection and testing of a sample of devices inspected and
    28     tested by Certified Examiners of Weights and Measures.
    29     PARKING METER INSPECTORS AS SUFFICIENT TO MEET THE INSPECTION  <--
    30     AND TESTING REQUIREMENTS OF THIS SUBSECTION IF STATE

     1     INSPECTORS OF WEIGHTS AND MEASURES CONDUCT INSPECTION AND
     2     TESTING OF A SAMPLE OF DEVICES INSPECTED AND TESTED BY
     3     CERTIFIED PARKING METER INSPECTORS.

     5     SECTION 3.  SECTION 4115 OF TITLE 3 IS AMENDED TO READ:        <--
     6  § 4115.  TRAINING PROGRAM.
     7     (A)  INSPECTORS AND COUNTY AND CITY SEALERS.--THE DEPARTMENT
     8  SHALL ESTABLISH BY REGULATION MINIMUM TRAINING WHICH SHALL BE
     9  REQUIRED TO BE MET BY ALL INSPECTORS AND COUNTY AND CITY
    10  SEALERS. THE DEPARTMENT SHALL ADOPT THE TRAINING PROGRAM
    11  PRESCRIBED BY THE NATIONAL INSTITUTE OF STANDARDS AND TECHNOLOGY
    12  FOR INSPECTORS AND SEALERS OF WEIGHTS AND MEASURES.
    13     (B)  CERTIFIED PARKING METER INSPECTORS.--THE DEPARTMENT
    14  SHALL HAVE THE AUTHORITY TO PROMULGATE REGULATIONS THAT
    15  ESTABLISH TRAINING AND CERTIFICATION REQUIREMENTS AND PROCEDURES
    16  FOR CERTIFIED PARKING METER INSPECTORS. PRIOR TO THE
    17  PROMULGATION OF REGULATIONS UNDER THIS SUBSECTION, THE
    18  DEPARTMENT MAY ISSUE A TEMPORARY ORDER ESTABLISHING TRAINING AND
    19  CERTIFICATION REQUIREMENTS AND PROCEDURES FOR CERTIFIED PARKING
    20  METER INSPECTORS. A TEMPORARY ORDER SHALL NOT BE EFFECTIVE UNTIL
    21  ON OR AFTER IT IS PUBLISHED IN THE PENNSYLVANIA BULLETIN, AND
    22  SHALL REMAIN IN EFFECT FOR NO MORE THAN ONE YEAR, UNLESS
    23  REISSUED OR SUPPLANTED SOONER BY REGULATIONS.
    24     Section 3 4.  This act shall take effect in 60 90 days.        <--
