        INTRODUCED BY KAISER, READSHAW, GEORGE, GODSHALL, CALTAGIRONE,
           HALUSKA, CAWLEY, WOJNAROSKI, SOLOBAY, HORSEY, DALEY,
           KIRKLAND, PISTELLA, BELFANTI, HARHAI, FRANKEL, LAUGHLIN,
           YOUNGBLOOD, COSTA, DIVEN, STEELMAN, PRESTON AND LaGROTTA,

        AS REPORTED FROM COMMITTEE ON STATE GOVERNMENT, HOUSE OF
           REPRESENTATIVES, AS AMENDED, JUNE 4, 2001

                                     AN ACT

     1  Authorizing the Department of General Services, with the
     2     approval of the Governor, to grant and convey the David L.
     3     Lawrence Convention Center AND OTHER INTERESTS situate in the  <--
     4     City of Pittsburgh, Allegheny County, to the Sports and
     5     Exhibition Authority.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8  Section 1.  Authorization to convey David L. Lawrence Convention
     9                 Center AND OTHER INTERESTS.                        <--
    10     (a)  Authorization.--The Department of General Services, with
    11  the approval of the Governor, is authorized and directed on
    12  behalf of the Commonwealth to grant and convey to the authority   <--
    13  BEHALF OF THE COMMONWEALTH:                                       <--
    14         (1)  TO GRANT AND CONVEY TO THE AUTHORITY created under
    15     Article XXV-A of the act of July 28, 1953 (P.L.723, No.230),
    16     known as the Second Class County Code, for a consideration of
    17     $1, the tract of land, with the structures, facilities,


     1     buildings, fixtures and improvements erected thereon, situate
     2     in the City of Pittsburgh, Allegheny County, Pennsylvania,
     3     and known as the David L. Lawrence Convention Center. The      <--
     4     conveyance shall include any property adjacent to the
     5     convention center that is acquired by the Commonwealth prior
     6     CENTER, AS DESCRIBED BY A DEED DATED JULY 1, 1975, AND         <--
     7     RECORDED IN THE ALLEGHENY RECORDER OF DEEDS OFFICE, JULY 25,
     8     1975, IN DEED BOOK VOLUME 5509, PAGE 13.
     9         (2)  TO GRANT AND CONVEY, BY QUIT CLAIM DEED, TO THE
    10     AUTHORITY CREATED UNDER ARTICLE XXV-A OF THE ACT OF JULY 28,
    11     1953 (P.L.723, NO.230), KNOWN AS THE SECOND CLASS COUNTY
    12     CODE, FOR A CONSIDERATION OF $1, ANY PROPERTY OR INTERESTS
    13     NEAR OR ADJACENT TO THE CONVENTION CENTER WITHIN THE BOUNDARY
    14     OF GARRISON PLACE, THE LOW TIDE LINE OF THE ALLEGHENY RIVER,
    15     THE EASTERN BOUNDARY LINE OF THE DAVID L. LAWRENCE CONVENTION
    16     CENTER, AS DESCRIBED BY A DEED DATED JULY 1, 1975, AND
    17     RECORDED IN THE ALLEGHENY RECORDER OF DEEDS OFFICE, JULY 25,
    18     1975, IN DEED BOOK VOLUME 5509, PAGE 13 AND PENN AVENUE THAT
    19     IS ACQUIRED BY THE COMMONWEALTH PRIOR to the date of the
    20     conveyance and any options to acquire such adjacent property
    21     held by the Commonwealth on the date of the conveyance.
    22     (b)  Easements.--The conveyance of the convention center       <--
    23  CONVEYANCES shall be made under and subject to all LAWFUL AND     <--
    24  ENFORCEABLE easements, servitudes and rights of others,
    25  including, but not confined to, streets, roadways and rights of
    26  any telephone, telegraph, water, electric, sewer, gas or
    27  pipeline companies, as well as under and subject to any LAWFUL    <--
    28  AND ENFORCEABLE interest, estates or tenancies vested in third
    29  persons, whether or not appearing of record, for any portion of   <--
    30  the land or improvements erected thereon.

     1     (c)  Labor contracts.--The authority created under Article
     2  XXV-A of the Second Class County Code shall be bound by the
     3  terms of any labor contracts relating to the convention center
     4  that are in effect at the time of its conveyance to the
     5  authority.
     6     (d)  Execution.--The deed of conveyance DEEDS shall be         <--
     7  approved as provided by law and shall be executed by the
     8  Secretary of General Services in the name of the Commonwealth.
     9     (e)  Costs and fees.--Costs and fees incidental to the
    10  conveyance of the convention center CONVEYANCES shall be borne    <--
    11  by the grantee.
    12     (f)  Hotel tax revenues not affected.--The conveyance of the
    13  convention center under this section shall not affect the
    14  availability of the revenues from the hotel tax authorized in
    15  section 1970.2 of the Second Class County Code to fund the
    16  operational and maintenance expenditures of the convention
    17  center.
    18  Section 2.  Effective date.
    19     This act shall take effect immediately.
